I don't think the feds should have gone after MS either (Apple and Linux anyone?) but I don't think the situations are very similar. Google has real, certifiable competition from Yahoo and Microsoft.
It could have been (and still can be) argued that Apple and Linux weren't (and still aren't) viable competition to Microsoft on the desktop. Part of the anti-trust was also that Microsoft was using undocumented API features of the OS to give their products (Media Player, Internet Explorer) an unfair advantage over competitors.
Not to get off track, but I think the feds went after MS because at the time, MS has ZERO lobbyists in Washington and didn't really play ball like the government wanted. Hell, Apple is way more guilty of anti-competitive behavior than MS ever was. The difference is Apple is still in the single (maybe low double) digit percentages on the desktop ownership market. | |

| From a consumer standpoint, there are other differences.
During the lifespan of a computer, an OS choice is one that is much more difficult to change than a Search Engine choice. Google has to work to keep a consumer that could wander off on a minute's notice.
If GMail had as many outages as Win98 had blue screens, it'd have no users at all. That reflects the much tighter hold MS had over it's users.
Another example is that Google's Web App Suite has done little to chisel market share away from MS office. This is in spite of the shortcomings that make up Office 2007. I'd say Sun Office has more dedicated users than Google Apps.
We can keep looking at the technical legal differences between possible monopolies, but monopoly laws are supposed to be consumer-centric. I believe the consumer has a much easier time of choosing alternatives to Google offerings than they ever had from walking away from Microsoft.

That's what I thought as well. So Google can't be considered a monopoly simply because it's not imposed on anyone.

Try an IROC races. Basically they give them all the same car and the same setup and get the best drivers so they're all basically the same skill level. They could only really pass the person who was in the front because he had no draft and the cars they were driving were basically stock cars. So pretty much what happened was they would run around the track for 100 or so laps all in one line. When the guy at the front screws up he gets passed by everyone and he moves in at the end of the line and round and round they would go moving up thru the line over and over again; whoever happened to be in front at the end won, and it was usually a Nascar guy because they were used to dealing with what stock cars so could stay at the front without getting passed the longest. -- Come let us reason together. | |

The problem is a miss uses of the definition of fundamental rights when applying it to the internet. Fundamental Rights have a few important characteristics, in theory they should never be taken away from the person. Secondly fundamental rights are immaterial by nature. Finally Fundamental Rights cannot contradict the fundamental rights of others; especially there are no fundamental rights to initiate an act of face against property and the body of others. Take for example free speech, I should have a right to free speech but I do not have a right to force my neighbor to buy me a pa system or furnish a computer and internet connection. | |

That is the basis of Civic Republicanism (having nothing to do with the modern Republican party). A virtuous citizenry was essential to a virtuous state. And, vice versa. Citizens were compelled to participate (jury, militia, etc.). If a state stopped engaging the citizenry (by compulsion), offering to let paid individuals do the job so the citizenry could relax, the state would be considered *non* virtuous. Contributing to what early writers called a "palsied" citizenry.
You may say that forcing individuals to participate in government isn't the same as buying them the tools necessary to participate. But, the principle is the same. Especially when you consider that another premise of Civic Republicanism was a child-like belief in never-ending frontiers (which essentially meant taking land from others, such as Native Americans, so that the state could continue to grow in a way to support Civic Republican's notion of the self-sufficient citizen soldier).

This weekend is supposed to be spotty weather at best so I am going to try and do it in between rain drops.
Nothing like real rainwater to make the lawn grow. Sprinkler system can't hold a candle to it - wrong nutrient mix I guess. | |

| I'm away this weekend handling some wedding prep stuff, but my Dad mowed my lawn for me. I didn't ask, he volunteered and told me after the fact. That said, he said he had to do it twice, and had to rake the lawn afterwards. (Too many clippings to leave, and the Town of Huntington doesn't pickup grass clippings, so he stuffed about 8 bags of clippings into a Maxima.) Sept 26th is the big day. We just spent the weekend finalizing 90% of the plans. Successful weekend. No speeding tickets back from Massachussetts, no traffic, and beautiful weather for the Cross Sound Ferry. | Been a interesting week on the railroad. Finished a new railroad crossing with gates and whatnot on a upgrade for the city of Brook Park, OH. The intersting part of all of it was we were in the same lot as at&t's Brook Park central office on Hummel road. Of course burring cable for the new crossing equipment had to be done around all of the copper and fiber going into this place. Last week a bunch of contractors came into the place to double the size of the C/O building to get it ready for U-Verse in the area. Before you knew it they got shut down because they didnt obtain local building permits! Priceless! | |
