YouTube infringement case may have gotten weaker

Google is in the midst of a $1 billion copyright infringement lawsuit filed by Viacom for YouTube violations of copyright infringement. Google hopes that a recent ruling in the favor of video site Veoh will mean good things for the YouTube case. In both the Veoh case (filed by porn company Io after the company’s adult films were found on the Veoh site) and the YouTube case, the defendants’ believe that they are not responsible for hosting liabilities because of a “safe harbor” clause in the Digital Millennium Copyright Act. These sites are simply service providers that have to do minimal things to make sure that copyright isn’t violated. The court has ruled that this is true in the case of Veoh. Google believes this helps its case against Viacom but Viacom says that there are enough differences between YouTube and Veoh that it will continue moving forward with its case. Viacom believes that YouTube is a site built primarily on pirated content and that Google is aware of the problem and not doing enough to prevent it which they say was not necessarily true in the Veoh case. Copyright attorneys seem to agree that the case is precedent-setting and serves as a setback for Viacom but doesn’t necessarily mean that Google is free and clear.

And, preventing good non-copyrighted material to appear on You Tube while "policing everything" would be an absurd expectation for any company or industry.

Viacom needs to find a better way of making $$$ than by siphoning creativity for the petty business of marketeering. Far from being damaged, Viacom is just seeking moola and open-ended rights to nearly all material.

Say "poo" to you, Viacom. "Boo hoo" to you, and that is what I say.

keep in mind Viacom expects google to police the some 60,000 videos an hour or something for copyrighted content. because in the Viacom fantasy world all content is policeable.

I've seen a fair number of videos on youtube, and I'm pretty sure all of them were not copyrighted material. While I'm sure you can find it, it's hardly the majority. So much of youtube is mediocre, and if that is copyrighted, it's not worth the effort to copyright it.

I don't care if it is Youtube, Veoh or any other site. Your not allowed to be on those sites in the first place. Even more is upload anything you make yourself. Starting today i'll make sure your bandwidth is throttled. Be it call comcast up, threaten to ligate or even take your own work down. So you go and buy my Dvd's / Cd's or any other media I put out. Even if you don't like what I have if you don't buy your not a real American. A real American is supposed to enjoy the trash I put out. You hear that? if I ever catch you on one of those sites! I'll make sure that my lawyers are everywhere. BTW: We already have our lawyers watching you under your beds. We never leave your room. We setup motion detectors, ear pieces that can pick up low sounds and even hidden cameras (we care about your privacy to sleep with your partner, but at a time like this it is ok for "us"). If you want we will not take your "love life" to court. Better yet we will just omit your private parts, while keeping your face for identification. We were afraid you might be listening to questionable material (Be it hate material against us, something you created yourself that is educational or entertainment otherwise). In your bathroom as well. So we installed their couple too. So No other contents for you you been warned.

How does this help Google?

There is one big difference between this case and the viacom case.

The porn industry never sent Veoh a C&D order, Viacom sent hundreds.

Viacom send the C&D and only sued when Google didn't pull the vids.

Veoh got sued before any C&D was sent.

If anything the Veoh ruling says, you must serve notice for a site to be held responsible.

Viacom has been trying to prosecute many companies on the basis of copyright infringement for the last few years and in any cases been unsuccessful, its just another way for them to make money,I am glad Google and Veoh won these lawsuits.

Most of the YouTube content is shared by users... Viacom, get the facts right.

Copyright

All material is protected under copyright as soon as it's created. So, infact, all content on Youtube/veoh, etc is infact copyrighted material, however the legitimate content was legally distrubited vice pirated content.
