Says they'll lock customers into 2-year deals with 'price for life'
01:44PM Tuesday Jun 10 2008 by Karl Bode
tags: competition · business · bandwidth · cable · Verizon FIOS · RoadRunner Cable
Time Warner Cable chief operating officer Landel Hobbs says his company is ready to do battle with FiOS in NYC. They already offer a 20Mbps tier to some users in NYC, and NYC will be a launch priority when they get around to deploying DOCSIS 3.0. Hobbs also says they'll stay competitive by offering a "price for life" promise if the consumer signs up for a two-year contract. That's something both Qwest and Comcast (without contract) have tinkered with, though it's not always worth it for consumers. Hobbs lays out the gameplan:
Click for full size
"HD in vast numbers, Start Over will be launched in Manhattan before year end, price-lock guarantee throughout the entire market, scouring the market ahead of anybody before the competition moves in,” Hobbs said at the conference. “That’s what we do in every area, whether it be AT&T or Verizon. That’s how we can compete. We’re very effective in getting out ahead of folks and implementing some of these things that, for us, have been proven effective."
I imagine that confusing their customers into thinking that using fiber in their network is the same thing as fiber to the home is also effective. The question I'm interested to see answered is this: If Time Warner Cable goes forward with their 5-40GB cap trials, will they shoot themselves in the marketing foot and impose caps in FiOS markets, or will the caps be reserved for less competitive areas?

Cable Company?

Do they think their same ol phone company ad is creative? Cable companies have a worst reputation. They're on par with oil corporations in the eyes of the people.

Re: Cable Company?

Plays Titantic music for Time Warner. One cannot make a sinking ship stay afloat. If they continue down this path, three things will happen.

1) Customers will be confused about the various services (ESP with Time Warner's fiber no fiber debate)

2) Customers will opt for month to month to see what happens and avoid long term contract.

3) Customers will go elsewhere like Verizon.

I'll never understand.

It must be area specific...here in San Diego I've got Time Warner and I couldn't be happier with their internet offering. It's the fastest around and quite stable. Their phone offering sucks (forced VoIP modem rather than using the phone jacks in the residence like Cox does) and their TV offering isn't that great compared to DirecTV. But that's okay...I've got alternatives for those.

Good question

Although I hate both Verizon and Time Warner, I'd much rather deal with Verizon. I've found my local Time Warner office can't even configure a cable box, let alone run a data network.

Had my FIOS here in Arlington, VA (just outside DC) since June last year. Very happy with the service. Initial installation was shaky but been rock solid sence. Just before I moved to my current apt I had Comcast whom I hate and asked if they would offer me a deal if I stayed with them. They choked and I sent to VZ. Now I get flyers at least twice a week from Comcrap begging me to take them back. Yeah right!

This resonates in bold print through the head of every TW broadband user I know.

With TW now discontinuing newsgroup service, and verizon still having their free included one for FIOS, it's a complete no-brainer that I am going to FIOS as soon as it becomes available here. Well, if it does.

Contract and Cap?

If a customer is under contract (2yr) and THEN they add the cap, I would think that the cap would not apply until after the term of the contract. Otherwise they would be changing the terms of the contract.

No, the contract will state you AGREE to anything like caps, throttling, blocking, banning, filtering and therefore if they implement them it will not allow you an out or avoiding an ETF....

All present-day contracts (of all sorts; doesn't matter what for or who with, from ISPs to insurance policies) have a clause in them that says the equivalent of "You agree to any amendments or changes to this policy/contract in the future".

When I have the opportunity to sign such paperwork in person, I often will cross out that section of the contract + initial the cross-out, then point out to the individual who's reviewing my signature that I don't agree with that clause. Most of the time they initial it as well, and it's approved.

You have to be careful when you rely on this alteration to the contract since I have seen cases where the other side claims that their representative does not have the authority to alter the contract like this (ie: Agreeing to your alterations) so the alterations are void and you agreeed to the unaltered version of the contract.

Which price is locked?

Without reading anymore than what is posted here I must ask: Will they lock the bottom line price or the above the line price?

I see it as a price lock above the line that will allow them to continue to add price increases below the line.

The truth we already knew.

Well, we already knew it, but their marketing plan confirms it. They will be clogging their own pipes. I firmly believe that no metered plan is going to work state side. The reason--I'll say it again. It boils down to the old mantra "It's the economy, stupid." The timing is just plain wrong. (It may fly in Canada, their economy is doing much better than ours.)

If the cable companies are at all concerned that their growth has stalled, their newest plans may well drive down subscriber numbers. (Hmmmmm, wonder if locking in under mulit-year contract means there are some in the marketing departments sounding words of caution.) When you look at real inflation--the figure that includes food and energy costs unlike the conveniently crafted term of art "core inflation" developed by the Nixon administration to keep the federal government's calculation of the CPI artifically low for purposes of calculating annual cost of living increases for entitlement programs--we're on the edge of reaching double digit inflation. If the commodities markets aren't reigned in and energy costs continue to escalate at the current pace, watch us enter the realm of double digit inflation before the end of summer. Also, see those living in urban areas start to have to spend more than 4 percent of their income on gasoline. (The NY Times article yesterday mapped those regions where the cost of gasoline is eating up 8 percent or more of incomes. Right now it's mostly in the more rural areas of the country. However, with the constant upward pressure of crude oil prices, more highly-paid urban dwellers are going to find themselves paying closer to what their rural cousins are now.) Furthermore, those manufacturers who haven't been passing along the full cost of the increased price of production due to crude oil price increases can't continue to do so much longer. Be prepared for a double or tripple whammy to your house hold budgets by the 4th quarter of this year.

The point of my doom-and-gloom scenario? US consumers are to the point of being tapped out. As pressures increase on them to the point where there are hard decisions to make about essentials like food, shelter and transportation to-and-from work, a growing percent of consumers will begin to scale back on non-essentials. And to most, except perhaps broadband report readers, this includes high-speed Internet.

So go ahead, Time Warner, Comcast and others. Your greed will be a boon to less expensive DSL, where available. And some, who may only surf and check email, may actually go back to good old dialup.

Shhh, there is a huge market for "Digital ready antennas", WalMart would kill you if they found out you let that out of the bag.

Yep, you do not need anything special to get the digital broadcast, we are talking about RF signals, still the same ones just a little different.

Crazy and sickening to me how people make so much money off of those who do not know. I never see any commercials that tell people that, I just see over and over commercials about the stupid boxes.

Caps for life and they charged me extra for HD boxes

No thanks. And while TWC is offering a 20Mbps tier in NYC, my understanding is that Verizon is already doing capless 50Mbps/20Mbps in Brooklyn.

BTW, I was charged extra for HD boxes by Time Warner up until I cancelled a few weeks ago.

Exactly like Verizon FiOS TV, TWC HD programming was free, but they're lying if they say they don't charge extra for HD boxes. I was charged a $5.00 premium on TOP of the regular $6.95 box charge for each of my HD boxes for a total of $11.95 per HD box for rental.

Thankfully they're gone for DirecTV and my 30Mb FiOS is being installed on the 19th. Yay.

Re: Caps for life and they charged me extra for HD boxes

20 mbps tier is undocumented by TWC. I've heard from TWC techs that its been grandfathered. I got it by a automatic upgrade from 8/512 (called RR Premium) to 20/1 (called RR Extreme) on my bill and on my modem's speed profile. Also was created was RR Turbo (15/786) and RR Standard got upgraded from 5/384 to 10/512.

Out here, RR Extreme was bumped to 15/2 (in response to widespread FiOS deployments) a number of months ago.

But while a lot of east coast FiOS markets are offered 20Mb, 30Mb and 50Mb speeds for sub $100/mo prices we have the nationwide pricing schedule (5/2-$43, 15/2-$53, 15/15-$65 and 30/15-$140, M2M prices are a bit higher).

So long as Verizon holds speeds down out here, so will TWC.

Price for life of a contract

The two year agreement states, that they will extend it for another two years but reserve the right to adjust prices at the extension. I.e. you get $100 for three services for two years, but when the renewal is due they can increase it (and you'll have $150 bill for the next to years).

They already have different speed tiers and prices in their different regions so I think that the selective application of caps will also be something that they can get away with (so long as it is applied to all of the region/TWC-Division).

Cable is posed to give you fiber

What many seem to forget, or just do not know, is that cable is has fiber to the node. In most cases this is within a city block. With that much fiber already deployed what do you think the cable company has to do to get it to your home?

It is far less expensive for the cable company to deploy fiber to the home and they are sitting there ready to do so. Many small cable companies have already ran the last bit of fiber to homes and taken out the coax.

Where does Verizon have fiber? To there CO. Okay, so they have to run all that fiber to places where the cable company, almost all of them, already have fiber to. So the cable company just has to run a little more and can do so quickly. Verizon on the other hand will have a lot harder time, and a lot more expensive time, getting that fiber to the home.

What does this mean. Cable companies compete as they are until there is the real demand and/or need for the fiber all the way to the home. Cable could easily dominate the market because they are "posed to deploy". Cable has there guys "sitting on the fence" waiting for the word "go".

Will I ever see FIOS, probably in about 5-10 years, maybe. Will I see the cable company do it (or in my case another entity), I think so and within 5 years.

So watch it Verizon and FIOS fan-boys, cable is in a much better position to compete. People think cable is a one trick pony but they certainly have far more fiber passing far more homes (probably in the millions) than Verizon will in the next 5-10 years. Again, cable ALREADY had the fiber there.

Well I would be delighted and I may consider not switching to FIOS if Time Warner can FIX, NOW, my download speeds at night that slow down to a bit better than dial up speed. It's great in the morning but useless at night. If anyone from TWC is reading this you should think about attending to today's problems because today's problems aids tomorrows competition. face facts...

one problem the cable-cos have is that they are in the business of selling content.. that was their primary mission/business plan. now that the internet is evaporating their business model, they will be as stingy as the telephone companies were on the upstream to avoid (stall as long as possible) cannibalize their core business of providing cable-tv (at ever increasing rates). telcos had their QOS business grade lines which is why they toyed with asymmetric DSL for so long (telcos were addicted to selling bits per mile access at prices which make today's gasoline look like a bargain).. but realized that cable-cos were going to get into the VOIP/phone line market so they had to throw customers a bone. now that some residential customers have seen the light of fast broadband.. there is no going back. customers will vote with their wallets on which is the best deal for them. however...

20/1 vs 20/5 is a hands down loser for time warner. they must get the upstream to AT LEAST 5mbit to be competitive and match the rate. as docsis 1.0 - 2.0 performs, nodes get hammered or are under-performing compared to FIOS, customers are not dumb, they will figure out whos got the goods (ie better broadband experience). time warner must do this right or they will see how fast verizon can pivot these customers into triple play (phone & tv service). FIOS internet (not so much, the tv & phone) is the best of class service which is the hook that may drive tv & phone sales. just as cablevision drives home the point that they are the dirt cheapest tv, phone internet provider with $29.95 triple play.

The FIOS builds promise GPON infrastructure, so count on speeds between 50-200mbits asymmetric or at least 50/50 symmetric become the norm entry level in the next couple of years (NY metro). 20mbits will be the lite tier , while those in the broadband swamp will be doing windows vista updates overnight as if it were dialup.

Verizon will continue to get customers to move from Time Warner and other competitors in their market. Then, the corporate monster will come out with caps on how much you can download and upload per month.

The only reason TW can give away the store with "lifetime" pricing is becausing they realy heavily on contractors and sub-contractors which cost them less. In essence these contractors ,in the form of lower pay and benefits are subsidizing their customers.

And in NYC ,the home of the most multi-millionaires, you have the working class people working for less so that Joe Millionaire can save a few dollars.

Ironically ,the TW execs do not "cost less" then other execs at similar companies..

sad but true!

Re: giving away the store

If TWC does impose caps on users. They should impose them on everyone. None of this NY wont have caps and rest of you will.
