UK frowns on copyright infringement
(old news - 02:20PM Saturday Oct 20 2007)

Have you ever headed to TVLinks to find access to your favorite television shows online? You won’t be doing so any longer. After months of topping the lists of blog posts dedicated to pointing you in the right direction for streaming video of popular television shows, the site has been shut down. The owner of the site, a 26-year-old man in the UK, has been arrested for his role in the piracy. What’s interesting here is that the site itself hosted no content at all. It simply provided links to where content could be found online. So what’s the charge? Facilitation of copyright infringement. Does that mean that all of those people who posted on their blogs to lead people to TVLinks are at risk as well? That would be legally stretching things a bit but it’s a reminder to be careful about just what you’re linking to on a regular basis.

"Facilitation of copyright infringement"

In the US, the Supreme Court made that illegal with the Grokster decision. I suspect there is a similar law and judicial precedence in the UK as well.

So, mere linking isn't the crime. UNLESS you made linking to illegal content your prime business.

Re: ohnoes!

Not true. There is no such law in the UK.

He has not been charged with anything, just arrested on suspicion of copyright violation, then released without charge pending investigation. They have implied that he might be in some way hosting the content himself by 'embedding' the videos, relying on the lack of understanding of the technology amongst the police and the daily mail reading middle class to allow this untruth to go uncontested.

F.A.C.T. know full well this is not the case and he has broken no current UK law. What they have done is used the implication to get him shut down 'while they investigate'. They will drag out the investigation for as long as they can and try to bankrupt him with legal fees incurred in that time or cause him to have a breakdown from living under the constant fear of prosecution.

By the time they drop the charges in a year they are hoping the law will have changed (God help us internet-using Brits if it does) or at the very least TVL will have been replaced by other sites owned outside the UK (in which case it is no longer their problem). Either way they win and are off the hook with the big business media companies they answer to.

This case is being portrayed as a ham-fisted attempt by a watchdog with a limited understanding of the technology to attempt to deal with the new challenges presented by the internet. Nothing could be further from the truth. This is a calculated and cynical misuse of the legal system and taxpayers money to force a completely legal internet site to close because it puts them in a difficult situation with the industry that funds their existence.

Well said!

I never knew about TV Links until now but it sounds like something I would have enjoyed. Judging from the other responses here, a sad day indeed.

Companies not stepping up to air tv shows

Since BBC America or any other American network would not air the episodes to some of the shows on that site, How would I go about in watching the shows? Watch the crappy American remakes of those british shows? No way! Their is no other alternative except to use that site.

Let TV Links live on!

Re: Companies not stepping up to air tv shows

They want you to pay to watch their programs.

*IF* I watched alot of TV, I would just light up both DVRs and the VCR(yeah I still have one) and record the shows.

So, now that the asshats have taken TVLinks down, where will people head now to get the shows? BT? NGs?

been done before

I'm not sure how it panned out, but there were arrests for simply linking to sites that had DeCSS. I know Joh got off for creating the program, but I don't know what the final determination was for linking.

Sux

This sucks. TVLinks was a great site for material hard to find anywhere else. Facilitation of copyright infringement? If that's the case then aren't all ISPs guilty of facilitation of copyright infringement as well for providing the connection? Or the electric companies for providing power to the computers used? Or the manufacturer of the computer itself for providing the means? They all, technically, facilitated copyright infringement because without those it wouldn't or couldn't have occurred. Facilitation of copyright infringement is so vague and can be stretched so thin until everyone could be guilty of it. They should have hosted their site from Sweden where the Internet is still free. I wish the owner all the best for a great site and hope he returns stronger than ever from a free Internet country. In the meantime I hope 10 more sites pop up to fill the void.

This is what happens when you advertize stuff like this. Best to keep it on the down low.

...

this is getting sad. everyone so far have made excellent points. i just wish this thing would come to a head because i am tired of Riaa and mpaa dictating the law. good or bad clear laws need to be set down of what is and what isnt. good or bad laws need to be put down to protect legitimate users of services.

a few side questions, not trying to derail the thread.

if you download copyrighted material of a movie or song that already own, is that piracy? for example i own an eagles 8 track hotel california that i cant get a player for. if i download the cd is that copyright infringment?

is it the sharing of copyrighted material the illeagal part or is it the actual download. by having my media files searchable thru a service like kazaa never give permission for anyone to take them is it me that is breaking the law or the person that downloads it?

Good thing for mirror websites

»FindYourFix.com/ is a website that provides links to public domain videos, however it looks like a lot of those "public domain videos" came from the late TV-Links...

This is a great thing.

Piracy is not acceptable. I don't how you try to justify it. Guys justify their actions on To Catch a Prerdator all the time. Doesn't mean it's ok what they do.

Are you asking to be flamed? Touching a child and reducing a multibillion dollar company's profits from $50 billion to $49.5 billion isn't even in the same league.

Snortgobbler

No its not in the same league... the half a billion is waaaaay more important.

If it's a crime that helps a Corporatiom make more money, then our laws are all for it. If it's a crime that helps anyone else not make a Corporation more money, then it is certainly illegal and harsh.

It's all about the money.

Sad trend these days

...shutting down sites and places that merely point you where to find items you're looking for.

If this trend is extended and continued, you have to wonder where it will stop.

Businesses shut down because they "facilitated" access to things like Radar Detectors or Handguns, which were then used to break the law?

More like FU*^$D. I don't know what that would be short of... Anyways... By God(or Allah, or Krishna, or Odin, or "set of coincidences and natural factors including but not limited to the laws of physics and chemistry"(for the sake of atheists), or whatever you believe in)!!! These guys just don't understand, they should do it themselves and not lock other people up. Who wouldn't pay, say... 5-10 bucks per month for unlimited download of HDTV quality movies? The big-a$$ companies have the money for the servers... They are just too "conservative"(by which I mean F*&%#d up and lazy) to think about the great distribution tool that is given to them as long ago as the early 90's... Time to move on from VCR and DVDs... I call to you, General Public, don't stop "stealing" from them, until they learn they can't stop us, until they learn that the old saying is true... "(If) you can't beat them, join them."

Sad

I am now looking into cable on my computer that Ian pay for, because I'm in university, I can't afford to buy a TV and cable connection, and all I want to do is watch TV on my computer because if helps me study. I would be willing to pay 10-15 dollars a month for a similar service on a legal website but those are just to hard to find. The cable companies are just whining because they aren't computer savvy enough to benefit from the great wonder that is the interweb.

Hope is not lost.

For all of you who may or may not have been regulars, let's say you never went to the site, that way you cant be arrested, but you will remember that the two websites which host the good quality videos from TVLINKS were:

Veoh
Stage6 DivX.

Keep TVLINKS alive and continue watching, the videos are there you just have to find them people.
