He has not been charged with anything, just arrested on suspicion of copyright violation, then released without charge pending investigation. They have implied that he might be in some way hosting the content himself by 'embedding' the videos, relying on the lack of understanding of the technology amongst the police and the daily mail reading middle class to allow this untruth to go uncontested.
F.A.C.T. know full well this is not the case and he has broken no current UK law. What they have done is used the implication to get him shut down 'while they investigate'. They will drag out the investigation for as long as they can and try to bankrupt him with legal fees incurred in that time or cause him to have a breakdown from living under the constant fear of prosecution.
By the time they drop the charges in a year they are hoping the law will have changed (God help us internet-using Brits if it does) or at the very least TVL will have been replaced by other sites owned outside the UK (in which case it is no longer their problem). Either way they win and are off the hook with the big business media companies they answer to.
This case is being portrayed as a ham-fisted attempt by a watchdog with a limited understanding of the technology to attempt to deal with the new challenges presented by the internet. Nothing could be further from the truth. This is a calculated and cynical misuse of the legal system and taxpayers money to force a completely legal internet site to close because it puts them in a difficult situation with the industry that funds their existence. | |

| Sux This sucks. TVLinks was a great site for material hard to find anywhere else. Facilitation of copyright infringement? If that's the case then aren't all ISPs guilty of facilitation of copyright infringement as well for providing the connection? Or the electric companies for providing power to the computers used? Or the manufacturer of the computer itself for providing the means? They all, technically, facilitated copyright infringement because without those it wouldn't or couldn't have occurred. Facilitation of copyright infringement is so vague and can be stretched so thin until everyone could be guilty of it. They should have hosted their site from Sweden where the Internet is still free. I wish the owner all the best for a great site and hope he returns stronger than ever from a free Internet country. In the meantime I hope 10 more sites pop up to fill the void. | |

a few side questions, not trying to derail the thread.
if you download copyrighted material of a movie or song that already own, is that piracy? for example i own an eagles 8 track hotel california that i cant get a player for. if i download the cd is that copyright infringment?
is it the sharing of copyrighted material the illeagal part or is it the actual download. by having my media files searchable thru a service like kazaa never give permission for anyone to take them is it me that is breaking the law or the person that downloads it? | |

| Sad I am now looking into cable on my computer that Ian pay for, because I'm in university, I can't afford to buy a TV and cable connection, and all I want to do is watch TV on my computer because if helps me study. I would be willing to pay 10-15 dollars a month for a similar service on a legal website but those are just to hard to find. The cable companies are just whining because they aren't computer savvy enough to benefit from the great wonder that is the interweb. | |
