Three ISPs now making new IPRED law useless...

Sweden's new Intellectual Property Rights Enforcement Directive (IPRED) anti-piracy law gives copyright holders in Sweden the ability to force ISPs in the country to hand over the names and addresses of users who transmit pirated material. Except Swedish broadband ISPs Bahnhof and All Tele started deleting consumer IP data, rendering the law somewhat useless. According to the AFP, Swedish telecom supplier Tele2 also now says they're deleting the IP information, as ISPs in the country field calls from P2P pirates threatening to cancel service. Of course the next move for the Swedish government will be to force ISPs to retain all user data for a set period.

Witch Hunt gone Pirate Hunt

The 21st Century witch hunt for pirates begin! Just like centuries ago, you could accuse anyone of being a witch. Today, we can accuse anyone of being a pirate and use the tried and true method of attaching a heavy rock to them, throw them into the middle of the lake to see if they float.

It was stupid then, and the same concept is stupid now. Glad to see people are fighting it on all levels.

Between Grandmom's, Kids, and Dead People being part of the people accused of pirates, all you need is a lawyer and a John Doe lawsuit. At least hundreds of years ago, it took someone to actually accuse, today we just get a lawyer to do it.

There weren't any old folks assaulted, but they did raid The Pirate Bay's hosting company and brought down a lot of websites that had nothing to do with piracy or TPB.

Seems Fair...

Provided that there is solid proof of piracy, which very rarely seems to be the case.

I think the defense teams have told these people during trials. The problem seems to be deeper, more like judges and juries are siding with industry against individuals.

Absolutely! That doesn't explain juries though. By now people should be aware of the fascist and rapacious nature/tactics of the music and film industry. If I were on a jury, I would NEVER rule in favor of these bums, no matter what the "evidence" seemed to say. Of course, I would likely never be allowed to sit on such a jury.

but if they make the same offer to everyone on the jury it'll be quite hard depending on the contry's laws on civil cases and if its civil or criminal (you might win on reasonable doubt in a criminal case in the US but a civil case they might still rob the person blind)

If it became a criminal case, you could always exercise jury nullification. Juror's rights seems to be almost unknown to most Americans; few folks realize that as juror's they not only decide innocent or guilty, they can do so based on whether they the feel the law should even exist in the first place.

In fact, in some states (such as Maryland) it seems that jury nullification even extends to civil cases (though I may have misunderstood Maryland's constitution as it relates to that). I wonder how many RIAA cases were tried in states where civil nullification exists?

Any attornies out there with knowledgeable opinions wanna chime in?

Paying your taxes and being a property owner puts you on the list as a possible candidate for a jury pool. Maybe just having a driver's license does it. Now I'm really in trouble. I'm on the notary public list, too.

Once a candidate, always a candidate, at least until you move.

Selected once by lottery from the pool in 2001 for a county court medical malpractice case, in the pool again in 2008. Excused participation last year because I had paid-for airline tickets for vacation. I said "try again" with a little more notice.

I'm in the pool as of two weeks ago.

Depending on how you answer the juror questionnaire, the lawyers for both sides get to reject a potential juror. I think there's a limit on how many rejections the lawyers can use.

I think the defendant's lawyers would want me on the jury. I'm pretty sure the plaintiff's lawyers would reject me.

Well .... If there is "proof", then I could agree with a government prosecutor issuing a subpoena for the data. But what we have here is a private company demanding data on what could be a whim. Why should a private company be able to circumvent due process?

I personally think they they should be required to turn off logging that could have an end-user's IP in it

(maybe allow true diagnostic logging but thats it)

The ISP should be reduced to only knowing what IP someone has right now

Don't know. Having run an ISP there is valid reason to have such data, at least for a time. Mainly for security reasons. It's nice to go back a bit and see if the spamming report was true, to know which account to cancel. Or the hack attempt from your servers was for real. Handing data over to a private company was always a NONO! Complying with a subpoena is another thing, and security audits are sometime necessary.

Well I could understand monitoring for spambots and such

but perhaps a script that would delete the uneeded data (ie below danger levels) so threats could be found

the law would take some iorning out to get the parts needed for security and anoninimity figured

We already have a law in this country. The government needs a subpoena to get data, how is the RIAA and MPAA exempt?

There's the problem. The Constitution guarantees us the right to be secure in our persons and papers. If we allow a private company to violate the constitution, then we allow the government, by corporate-proxy to violate it as well. That's the dangerous slope here. Deleting data is a bad thing as it gives tacit consent to the violation itself. One should fight this on more legal grounds.

I sure its more then just pirates IP's they delete.

What happens if someone visits a site with lyrics. That person gets boned as a pirate. Stupid stuff like that will end up getting the person in a suite and kicked off. I can see it happening now.
