Spyware, as it is known today, was business as usual on The Internets eight or even five years ago. The guy is 21 years old, and I doubt he even thought out the consequences of what he was doing at 13. Doesn't really matter though because what he did wasn't illegal.

Try again. Sorry, what he did do WAS illegal and always has been. The additional laws were created to make it easier to prosecute these sorts of scumbags. But exploiting security holes to place spyware on someone's computer has never been legal.
I find it amazing anyone would defend someone that exploited any security hole for their own personal profit at the expense of someone else. As someone that has spent more hours than I can count eliminating spyware from all of my computers and my friends computers, I think death by slow torture would be too good for these guys. These people are the scum of the earth and the bane of the Internet. Hiding behind age and lack of more explicit laws doesn't change that.

A Roman tyrant, Tarquinius Superbus received a messenger from his son Sextus asking what he should do next in Gabii, since he had become all-powerful there. | If a real crime had paid for his training he would be banned Since this spam and spyware money supported Begg-Smith and allowed him to train, I think Begg-Smith would likely have been barred by the Austalian Olympic Federation for failure to live up to the Olympic ideal.
But he didn't commit an officially criminal act.
We IT users and professionals have not lobbied and persuaded our elected officials to make the act of spamming and creating or spreading spyware serious crimes -- so legally he has done nothing wrong.
As citizens of democracies, it is our duty to bring the law in line with the consensus of citizens as to what is immoral.
