'Do Not Call' violators warned
(old news - 04:06PM Thursday Dec 18 2003)
tags: spam
It was a jolly day of beat-downs for irresponsible marketers, with Microsoft and New York Attorney General Eliot Spitzer announcing a series of spam related lawsuits. The FTC also issued their first warning for a "Do Not Call" violation. One of the spammer targets was Scott Richter and his company OptInRealBig, which Spitzer claims is the third largest source of spam in the U.S. Google News has a list of sources exploring the spam lawsuits. The suits also focused on New York e-mail marketing company Synergy6 and its president, Justin Champion. Microsoft is along for the ride, since many of the spammers used falsified Microsoft domains as origination addresses. Microsoft and NY investigators discovered that the spammers utilized hijacked PC's belonging to hospitals, schools, and even one foreign government's defense ministry.

In semi-related news, the FTC issued it's first official warning for a "Do Not Call" violation this week, reports Reuters. CPM Funding Inc., a California mortgage company, admits calling at least eight numbers on the registry. Though companies can be fined heavily for such violations, it can be assumed that the list's currently unstable legal footing has left the FTC waiting for clarification before enacting harsher punishment.

Lower spam today everyone?

Apparently, Hotmail had been setting "spamtrap" addresses from May 12 to June 13 as part of the investigation into Scott Richter & OptInRealBig. Millions of email spams were sent by the Richter & Company . . . 8,000 of which were to the spamtrap addresses.
Note: The following is a .pdf file - »www.oag.state.ny.us/press/2003/dec/syn1.pdf

Conjecture
Spammers may now know that Hotmail is "sprinkled" with these spamtrap addresses and may be laying off sending spam to Hotmail in order to avoid hitting these spamtraps and drawing attention to themselves.

I've been reporting every single spam that gets past the Hotmail filters.

My filters are fairly limited to ten rules and YES SPAM has started cutting back.

Lots of new "Non Profit" companies

"...CPM Funding Inc., a California mortgage company, admits calling at least eight numbers on the registry...." I wonder if they are one of the ones I've received calls from recently that start of with something like
"Hi, this is Joe Schmoozer with FlyByNite Credit Inc, a non-profit organization. Please contact me immediately concerning your pre-approved loan for..."
I'm wondering how many new "non-profit" organizations are cropping up in light of the Do Not Call list? I find it hard to believe that ANY company offering to refinance my home, or consolodate my credit cards with a new loan, etc. etc. is "non-profit".

Re: Lots of new "Non Profit" companies

I'm getting a LOT of calls from two groups now:

Law enforcement fund raisers and 'research' organizations that call me to do surveys about home products and other such things.....The former I suppose is non-profit, but the latter generally are selling that info I have to assume?

Re: Lots of new "Non Profit" companies

Although I have yet to comb over it closely, the law enforcement "charities" that call me are non-tax deductible. So I'm wondering if an organization without that exemption meet the qualifications for "charitable" orgnizations permitted by the DNC list.

I admit I don;t (yet) know....

Actually most of the fire/police charities that make phone solicitations are scams. We got called by a fireman's family fund and when my wife asked where they were located, address etc. they wouldn't divulge anything. When she looked up the phone number for said charity and called it they said that they never to phone solicitations so the guy who had called us was just using their name to rip people off.

InAtlanta

@bellsouth.net

Speaking of Law Enforcement charities.
My parents were out of town last holidays and i stopped by their place to feed their animals while they were out and ended up answering a phone call from one of these orginizations. After the "long-winded intro speil" i told them i wasn't interesed. The caller started to refer to me by my fathers name, and i began to argue the fact that i wasn't my father. Needless to say i hung up before it got anywhere.

Mid January he got a collection notice from the Orginization. Seems he had given to the charity before and they had his bank accn't info on hand and went ahead and charged a "donation" to it and he contested it via the bank and so they sent a collection notice.
Also after contesting everything and ending the collections my parents started recieving threatening phone calls from someone at this orginization.
Long story short, calls to the orginization were fruitless, and my parents had to file a complaint with Bellsouth and have the offending numbers blocked.
Since they went thru all of that it has turned me off on most of these charity places. Their tactics, even if it was isolated to one employee, seem shady at best.

The law enforcement fund raisers, and other supposed charities, may be cases where the telemarketing firm is taking a large cut of the "donation", perhaps as much as 50% - there are similar situations with door-to-door canvassers. This is probably one of their tactics to get new business, highly profitable arrangements with supposed non-profits. It may also be that some telemarketers, if not running and out-and-out scam, are doing the telemarketing for very dubious supposed charitable organizations and not asking any questions.

Re: Lots of new "Non Profit" companies

I hang up immediately as soon as they identify themselves or mispronounce my last name. Saves us all a lot of trouble.

Just makes me angry. A "Do Not Call" list should mean just that. It should mean I don't want ANY unsolicited calls and will not purchase/help/donate to ANY cause.

Re: Lots of new "Non Profit" companies

I use just my now much loved Inteliscreener. Most of the telemarketing calls I got were from the same 3 companies (MCI, Capital One and that pinko rag L.A. Times). No matter how many times I told them to drop dead and put me on their DNC lists they just ignored me. Now they're stored on my block list and are never heard from again. And any "out of area" calls get dropped too (private calls are already blocked by Verizon) Ain't technology grand?

I signed up my home and cell numbers to the "Do not call" registry, but I find that I am still getting calls from telemarketers.

Wasn't there supposed to be some number that you were able to punch in (after the call) to submit a complaint and report a violation of that DnC list?

When they authorized the Do Not Call List, they should have also enacted a law that all businesses including telemarketers cannot block their numbers from caller ID. Caller ID I feel is useless, all businesses block their numbers. Caller ID should also display what country the call is from if it is outside the US.

Then I guess this is just another way for the TELCOS to make money off people how buy the privacy director service to take the calls that are blocked.

That is part of the law. They were given extra time to comply since that can be tricky with many employees working out of their homes.

Probably an auto dial machine that is calling you - the kind Homer stole from Professor Fink . The recording or the TM on the other line never picked up to annoy you so you got the silence until hang-up. I think tele-zapper takes care of those types of calls.

I noticed that when i do get calls from telemarketers they are not quite so pushy. If i tell them no they generally hang up. I don't know if this is coincedence but before they would try and badger me into something. Personally i hate spam, whether it be over the phone or in my inbox. Unless I specifically request something I don't want them bothering me.

You actually listen long enough to see if they hang up? Why?

Politeness has no place when dealing with a$$holes that call you trying to sell something, particularly now that they are breaking the law to do it.

Just say "screw you" and hang up.

I am polite to Charity calls but NEVER give them anything, I don't want to encourage them calling people to beg for money.

The problem is the phone only rings twice and by the time I get to pick it up, they're gone.
This interruption, 1-2 times every day since October is really becoming seriously annoying. We are reaching the point where we ignore the phone now completely, and several times we ignored important calls.

After dozens of attempts at getting through the SNET/SBC's Annoyance Call Bureau, I was told that they cannot do anything about telemarketers because it's considered 'restraint of free trade'.
She said she could give me a free number change or refer me to the national do not call list and that is all.

My next step is to start with CT Attorney General, as CT has a law against auto dialers and I am convinced this is an autodialer that calls all hours of the day and night, and given we have an unlisted and unpublished number.

Re: M$ made this possible! Thank you M$ighty M$

I did tele-marketing part time for police charities about 15 years ago for about 4 months and let me tell you where that money is going - in the TM companies pockets. Approximately 90% goes to the executives salaries and the peons like me at the time got between 5-12 bucks an hour depending on hourly sales average. If a cold call asked how much money the response was something like "well after paying the light bills 100% of the money goes to the blah-blah charity".

Don't hang up the TM though. Best thing is to say hold on a second and put the phone down until they hang up. If it's Friday after work and your having a few beers keep them on the line as long as you can and then hang up. That will really get em! If you want to get really creative use some tactics from Tom Maybee Tele-Marketers Revenge CD - it's hilarious.

Here are some good responses to tele marketers -

ask a telemarketer selling windows if he could install a bay window in a minivan, ask a carpet cleaning service if they could get out human blood- lots of human blood and telling a caller soliciting charitable donations for the local sheriff’s department that you don't have time to talk because your busy making a pipe bomb.

Don't just hang up have fun and more importantly get revenge.

Never call an 800 number since there is no way to block your name or number. As soon as you hang up they sell your name, number and any other info they gleaned during the call. Ever notice how they ask 20 questions before helping you?
