Simply being accused of piracy means you're guilty...

Slashdot notes that New Zealand is poised to include a 'Guilt Upon Accusation,' clause into their copyright laws, which means that if an ISP user is simply accused of piracy then they are declared guilty -- the punishment being Internet disconnection. According to Torrent Freak, there were provisions included in the law that would address a grievance process for the falsely accused, but they were removed. ISPs, who say they weren't properly consulted, call this "a deeply flawed law that undermines fundamental rights and simply will not work."

I send an email to the New Zealand authorities of accusing their whole IP block of piracy. New Zealand will not longer have the internet.

i like that idea, shouldn't be that hard to figure out IP addresses that are used by NZ government. better yet, you probably could convince any politician that 127.0.0.0/8 should be banned. if you can get a real response from the idiot politicians, use a couple IP in the header of the email that they send back.

and that they should do MAC level banning of FF:FF:FF:FF:FF:FF

Did TaylorTroll move to NZ?

Some here might remember Taylor Troll. He would pop in during any discussion of copyright infringement allegations. The mere allegation that someone infringed copyright led him to conclude that the person should be stuck in jail for a long time. He was immune to arguments about due process and that they might be falsely accused.

Now it seems that people with minds similar to his, are writing laws in New Zealand. Who needs proof? Just the mere allegation of copyright infringement is enough to get you kicked offline with no recourse.

This law is ridiculously easy to abuse. Did you say something on your blog that I don't like? I'll just call your ISP and accuse you of copyright infringement. Bam! You're offline. Chances are, you won't even know who reported you so you can't retaliate. And even if I'm found out, there's no penalty for false reporting. A small group of like-minded individuals could force offline anyone who disagrees with them or opposes them. Scary, indeed!

Sometimes the government's response to a "problem" is a greater crime than the one they are seeking to correct. Once one suspends or eradicates, "due process" and "innocent until found guilty" you have an executive arm which is no longer democratic, or deserving of public support.

They consulted the public and due to this added provisions that allowed punishment for false or malicious accusations, but then after the public consultation process they were approached by "various commercial entities" and they removed those provisions. Don't take my word for it that's a quote from the official parliamentary record:

"The Minister [Judith Tizard] knows, and I certainly know, that we have all had approaches from various commercial entities, as a result of which the Minister has come up with a number of amendments. We will support those. The first makes some changes to new section 92A, and I need not go into that in any great detail. We support what is being done there. Essentially, it is putting back into place what had been there before the bill went to the select committee."

Not just for corporations....

I really hope these bafoons realize that copyright content applies to more than just businesses with any kind of financial interest. I can create an image, copyright my work, put no value on it and start throwing my weight around like the big boys.

You know, of all things about CR that gets me, is that it has the appearance that BUSINESS thinks that it's a tool simply for them, written for them, and applies only to them. I wonder, just how many times, they have abused someone else' copyright property with just walking away and dismissing it.

Back to NZ,.. I just hope they understand what kind of a can of worms they are opening up here. Like others have said.. might as well just shut their internet down..

12:01 AM the night the law goes into effect simply start contacting the ISP's and hosters of the various Lobbygroups and Copyright nazi's and so on and accuse them of piracy.

Have their websites shut down

That is what the telecommunications industry, internet service providers, user groups, internet advocates and IT professionals think of parts of the recently passed Copyright (New Technologies) Amendment Act.
“The Act gives no guidance on what ‘reasonably implement’ or ‘in appropriate circumstances’ mean,” Mr Chivers said. “This leaves the door wide open to those who seek disconnection of an alleged repeat infringer based on flimsy evidence, or worse, allegations alone.”

“Identifying repeat offenders will not be easy. A complex data matching exercise will be required, and even then it will not always be clear who the real offender is, particularly when an internet account is used by a family, a business or a school. The potential for an alleged offender to be denied natural justice is significant. For these reasons, a court order backed up by solid evidence would normally be required before taking such invasive action.”
