Prosecutors couldn't handle the case loads...

German prosecutors this week declared that they would stop prosecuting smaller scale broadband and P2P copyright violators, and instead only focus on commercial grade offenders. As in the United States, the entertainment industry uses the threat of lawsuit to scare individuals into pre-trial settlements, but in Germany, where P2P trading is more clearly illegal, prosecutors are apparently overloaded by the volume of suits. Instead, they'll now only entertain cases if the damage is greater than $4,500 -- so by one attorney's math, German P2P users will be able to have 2,999 pirated music files on their PC without repercussion. There are some exceptions -- users found trading films that are still in theaters will still find themselves in German legal hot water. Interesting that the level of infringement has to be so high in Germany. In the US you very quickly get to to the $4,500 mark.

This is very comparable to the prohibitions of recreational drugs:

    • Mostly victimless (pirates wouldn't buy the same things for full price; drug use among consenting adults doesn't harm anyone against their will or without their consent).

    • The prohibition is a pretext for government snooping into lives of citizens, and for industries trying to profiteer on captive markets.

    • When it starts becoming apparent that the prohibition is causing worse social problems than the prohibited behavior, legislatures finally resort to a more rational policy, but gradually, by lightening up on "small" infringements.

The drugs prohibition is a colossal failure if the purpose is assumed to be reducing the harm from drug use - but it's a big success so far as the purpose is expanding govenment power.

Likewise, the jihad against file-sharing is failing spectacularly at the supposed goals of either stopping copyright infringements or rewarding artists - but it's doing great for the political power of a few big companies.

German Courts buried by PORN pirates - not music pirates

As was noted in the link provided in this BBR story, the court overload was due to copyright infringement lawsuits from the PORN industry and NOT the music industry.

However commercial piracy is infact more harmful then p2p could ever be when the pirated copies with good replications of case, disc and paper art get into the general flow. rarely are p2p copies sold as if they are the real thing, people know its a pirated copy.

course you would have to be dumb to think the DVDs from that guy in the subway station/street corner arent pirate or legit copies stolen from the docks.
