Taxing local area networks

There's simply something about Florida and absurd network taxation. Apparently Florida's creative taxation efforts (which we discussed at length and provided exclusive documentation for last July), are in the news again. The state's previous efforts to tax companies making use of VoIP was so poorly worded, it could have been construed as a tax on any organization or person that operated a LAN. While those efforts obviously stalled, now the state is considering enforcing a 1985 provision that could raise taxes between nine and eighteen percent. The aged provision was intended to tax large utilities and companies providing their own communications services, but is again so broad, it may be used to tax any company operating a local area network.

Clueless Legislators

I hear various FL state representatives on the local talk radio station almost every morning, and some of them are so clueless about certain topics of importance that it scares me to death. There's a budget crunch this year so I guess they're scrobbling for as much extra dough as they can!

In 1700s in Europe they had a tax / house related to the number of smoke stacks and the size of the stacks. In other words you would pay tax for....smoke. This LAN tax, is just something like that, only the year is different....what a bad joke...

Yeah we've had a big budget crunch this year. And it's hurting alot of state agencies.

Plus you have to remember that we in Florida are going to get hit with stupid taxes by default. We don't have state tax. You tell people "Come to Florida, we have no state tax!" It sounds good so the old farts flock here, then you just hit them elsewhere. Higher utility taxes, property taxes, etc...

The biggest networks here in Florida are the governments. So all they are doing is shooting themselves in the foot.

Plus when you are paying blood money to the legalized mafia (Big Sugar) you have to make those loses up somewhere else right?

I'll still trade you my Cook County, IL property tax rates for yours in Florida any day.

My favorite (so far) Florida tax is the one on "Intangible Personal Property". I just filled that one out for the stocks in my father-in-law's estate. It's a short walk from taxes on loans, trusts, bonds, to intellectual property and even 'profitable thought'.

But yeah, it's getting (or is already) out of control.

Or at least be honest about it. Come out and say, we're out of Money and are increasing your income tax.

In my opinion, they only thing that should ever be taxed is income. All other taxes are just a way of taxing your income in a different way.

hmmm...

...any PC which used Ethernet to connect to a DSL or cable modem has a LAN (admittedly a small one, with just two nodes), so there's plenty of revenue opportunity.

I have a better suggestion: there used to be a window tax in 17th-century England, which is why you see blocked-in windows in a lot of old houses. Given the prevalence of GUI systems, maybe Florida should enact a window tax?

Let's get this stopped

I've contacted the Miami Herald and Sun Sentinel and asked them to run an article on this. I spoke to their writer who covers the State Legislature and apparently this is the first they've heard about this tax. Hopefully some press coverage will get Rep. Stargel's bill moving. My guess is that most people with home networks in the state are oblivious to this pending tax.

Also call your state rep. and senator and ask them to support house bill 735 and senate bill 2302 respectively.

What are they going to do? Have an assessor come to each and every home and say "You have a cable modem. We have to charge you tax on that." "But I already pay a sales tax on my cable." "But there is a LAN tax now, which your cable modem falls under." Double taxation. And how would they tax it? By the foot? What about Wireless LANs? This tax is completely stupid. Of course, looking at who the governor is related to...

Well I guess it's possible they could require retailers to have customers who buy networking products fill out a form that would then be sent to the DOR. Or for the Wireless LAN's they could send their tax men "war driving"

Every state in the union is scrambling to make up deficits. LAN Tax? come on.. they should stop taxing the hell out of us. (If you are a Metro-Miami resident then you know home insurance is $500/mo!!!) I went to North FL near Gainesville and taxes werent so bad. If you ever visit Miami I recommend you take the bus or w/e because dont bother driving with all the deadly road-rage idiots on US1 and 75.
