| such bs Man this is such bs - For the record I will say that if your getting spammed its your own damn fault. Your inbox CAN be configured to BLOCK all emails other than from approved lists and addresses via plenty of freeware and configurations. No one is attacking telemarketers when they "hide" their return numbers to get you on the phone and no one is slamming major credit card companies for mailing me hundred of "Your approved for this credit card" crap in my mail at home per year or car companies who are doing the same sh*t about get this car for nothing!!! So why is the government and media pressing this issue about spammers, because people are too stupid to realize that they have tools they can use to solve it???? I don't understand why in today's world spam is even a crime. Hey I got something to sell, wanna see what it is? I hate to break it to you but in this world everyone needs money and as a result you are either working for someone or working for yourself and if spam is the easiest way to work for yourself and make big dollars so be it. You are not gonna feed your family off love. I also want to point out and clarify what "I" define as spam. Commercial e-mail either solicited or unsolicited, that is propegated by misleading and un clearly defined subject lines and headers. Meaning that the subject misleads the user into opening mail and the content of the "opened mail" is unrelated to the subject or heading. As long as mails come to me with a clearly defined point and subject that is relevant to the mail then by default it should not be considered spam. But then again if you don't email me from my website and get a specific subject line, or your not in my approved lists then your not getting in my inbox anyways. Go find some drug dealers and rapists leave this guy alone, there are bigger problems to deal with in the world. | |

| The big point is that spammers via email consume the resources of other people in order to send their email.
For flyers or drops done to your home via the postal service they are actually paying to have it delivered. That is why it is such a big deal.

| Just because there are plenty of ways to stop spam from entering your inbox that doesn't validate the spammer. To be honest I'm not all that upset about some email advertising. After all advertisers have to promote product and their clients need to sell their wares. However there is a big difference between a spammer that is honest in their solicitations and actually follows through with the "opt out" promise and spammers like Alan Ralsky. If we didn't have so many emails trying to sneak by illegitimate means I'm pretty sure you wouldn't be seeing this much outrage. | |

| What's the Diff? I have to ask the community. What is the difference between the spam this guy generated and telemarketers or direct mailers? If I don't ask to receive any of these aren't they all just as bad? Shouldn't they all be prosecuted and outlawed? Do the later 2 get a pass because they have been around so long? Isn't he just doing what the other 2 already do, just on a bigger scale? Was he sealing illegal drugs or other illegal items?
Personally i don't care what happens to the guy or any other spammers. I use a junk email account for "stuff" on the web and only get a handful of spam that must be manually deleted. Certainly not an overwhelming task for myself although I have met those in life that it may be a big task for.

| said by pbaldwin :I have to ask the community. What is the difference between the spam this guy generated and telemarketers or direct mailers? Telemarketers are covered under the do not call laws, in the US anyway. And they can and are nailed if you ask to be removed.
Direct Mailers get a pass because 100 percent of the cost is absorbed by the Direct Mailers, unlike emailers where far more than half of the cost is absorbed by the recipient. I don't think they should get a pass, there should be an opt-out/do not mail list for them also.
But the argument that A is bad and is allowed so we should allow B is invalid. We should fix the problem with A, not ignore B.
If I don't ask to receive any of these aren't they all just as bad? Shouldn't they all be prosecuted and outlawed? Do the later 2 get a pass because they have been around so long? Isn't he just doing what the other 2 already do, just on a bigger scale?
Yes to the first and second question. See above for the third.
What he was doing was ignoring the law, on a VERY big scale. Not only in volume, but also in the number ways he was not compliant. He did not honor removes, he forged headers, he did not identify himself....the list of specific violations is pretty long.
Was he sealing illegal drugs or other illegal items?
Yes, but that does not matter. Spam is spam regardless of the content. Selling illegal stuff is just another violation.
Personally i don't care what happens to the guy or any other spammers. I care. I am the sys eng for a school district, and we spend time and money stopping his spam. Money that should be spent educating children, not lining his pockets.
And that is the answer for all you that say 'get a filter'. Large scale fitlers for a few thousand employees are not free, nor are they cheap. Nor do the run themselves.

| Let me ask this... So it has been established that the only people that spammers REALLY hurt is the ISPs that have their bandwidth chewed. With the huge fines being imposed on spammers, is one red dime of that going to the ISPs? To the victims of the spam? No. I'll tell you where it's going. Into the coffers of the states that are passing these ridiculous laws.
State Senator #1: Hey Joe Jack these "spammers" are making a ton of money, and we aren't getting our cut.
State Senator #2: Well, that's an unacceptable state of affairs, now ain't it. Just what do you suggest we do about it?
State Senator #1: Lets make it illegal and charge fines of $50,000 a day. That should offset some of the pork we've been blowing our budgets on.
State Senator #2: I like it! Lets do it! -- Even a broken clock is right twice a day.

1 edit | Re: Let me ask this... said by bent :So it has been established that the only people that spammers REALLY hurt is the ISPs that have their bandwidth chewed. No, that has not been established. Not even close. In fact common sense tells you just the opposite is true.
We pay for our bandwidth, we pay for the HD's that the spam sits on in the inboxes. We lose productivity of employees as the sort through the stuff. We spend money and IT personel time stopping as much as we can.
And for the record, your ISP does not have an unlimited amount of free bandwidth laying around. YOU pay for the incoming spam costs they incur in your monthly fee.
MY small local ISP went from 6 total email servers to 13, just to handle the increase in spam over the last few years. Those servers are not free.
Edit: Oh, and it was the FBI that went after him, under federal law. This has nothing to do with State Senators.

| Re: Let me ask this... I was really referring to the Oklahoma case of a few weeks ago where the spamer was fined $10M. So far, I haven't seen any evidence that spam is more than an annoyance to anyone but ISPs. Sure, it costs the ISPs a few dollars more for the extra bandwidth and servers. If they want to stay in business, they will pass that along to the customer. Big deal. My already over-priced internet connection costs a dollar or two more. Really, the most vocal people against spam are the small ISPs who want to be able to increase their margin so they can make a few extra bucks.
You know what? If you want to stop spam, make it a crime to respond to it. -- Even a broken clock is right twice a day.
