Comcast has apparently assigned a damage value for those customers who accidentally saw genitalia instead of Kurt Warner over the weekend, the Tuscon Citizen saying the company will dole out $10 credits to customers who witnessed the accidentally broadcast Superbowl porn. "While this credit won't change what happened, we hope that it will demonstrate to our customers, and to the Tucson community, how seriously we are taking this situation," says Comcast, who is still investigating exactly what happened. The company has been hinting that they believe the act may have been intentional and malicious, and has ruled out equipment malfunction.

Well, I'm just amazed some trial lawyers didn't get on board and run commercials. Were you underage children watching the Super Bowl? Were they exposed to Pornographic Material that forced you to explain to them what happened? If so, Contact so and so for a class action lawsuit... As legally, I am sure people could sue. Porn is illegal for anyone under 18 and the fact that one could claim their child saw the images would be violating the law.

So 10 dollars? Seems Comcast is trying to hope people take the deal and "settle" versus sue. Not that I think ANYONE SHOULD SUE HERE. It was a mistake, but it just seems like they are trying to mitigate their liability. Accept this and our hands our freed from you.

More like litigious and willing to sue over anything.... Odds are little Timmy has already browsed porn on his P.C. and not as innocent as his parents think. Not that pumping 10 seconds of porn to possible children viewers is right. However, mistakes do happen. Being most probably don't use OTA analog, I am sure those that saw it were minimized by this fact. Still, I am extremely surprised ambulance chasers have not gotten on the suing bandwagon. Maybe it's just too early, as they have to write up the paperwork first.

I don't agree. Listen, mistakes happen. I don't think they INTENTIONALLY did anything wrong. I don't like Comcast either, as they are shady. Still, you can't go pitch fork and mob over something that was an accident.

That's not the point. No one is claiming to be scarred for life because they saw a penis. When one watches a cable channel, there is an expectation that one will see what one paid for. To inject a X-rated movie clip into a PG show is violation of that trust (and contract for that matter).

I would expect someone to complain if they tuned into a porn channel expecting to see a pron movie & instead had bits of the Oprah show (or a televangelist) pop in during the movie.

Its not about whether its bad to view porn, or whether Americans are uptight about sex, or if people are "scarred" for having to see porn when they had no intention of doing so. Its about a company that took someone's money to show them one PG-rated football event, and showed them an X-rated clip during it. That's wrong. The $10 is a reasonable attempt by Comcast to make up for their mistake.

Pretty easily, actually. You're looking at it from a restorative perspective (ie: how can one be "restored" by $10). But again, the point is missed. One can not be made to forget what they saw. Its impossible. But if one pays Comcast $50 for a month of TV of the buyers option and Comcast chooses to violate (willfully or not) that, then certainly refunding a portion of the monthly contract amount is a "reasonable" attempt at a solution.

It may not make everyone happy, but nothing will.

I won't argue that it shouldn't have happen. Saying that they violated trust I'm not so sure about. I don't explicitly "trust" any company but I know what you mean. I won't however agree that it was a violation of contract. Show me an contract (or user agreement or terms of service or any other "offical" document") that says anything about them not doing what they did. Good luck finding it.

If it was a PPV video (porn or otherwise), I would expect a refund of the purchase price of the movie as it wasn't delivered in an unaltered state. If it was on a standard channel, i would expect a complaint to. And if they want a partial refund for the period of time that normal programming was interrupted, that 30 seconds was about 1/10 of 1%. At $100/month for programming, that comes to 10¢... or slightly more then nothing.

Does $10 really "make up" for the mistake? Are you saying that you didn't want to see it, but for $10 you'll feel ok and well compensated for having to watch it? Are you saying that $10 makes up for having to have a conversation with your daughter (or son) about what they just saw?

My answer to all of the above is no. It doesn't really "make up" for any of it. Nothing will make up for it if you really were offended. If you were offended, you should want to make sure it doesn't happen again and the appropriate people are punished if applicable. If you weren't offended, just move on.

It's nice that Comcast is offering a $10 credit. I'm saying that, to me, it's not necessary. An appology and knowing what actions were/are being taken to prevent it again would be worth more. Plus ultimately that $10 credit is just going to be paid for by customers anyways.

Its irrelevant what the TOS says or doesn't say (in this case). When one buys something there are implied warranties that do not have to be stated. Here's Comcast's disclaimer of warranty (caps are theirs):

Seems pretty straight-forward: "we're not responsible for anything". Except for the last 7 words: "unless otherwise prohibited or restricted by applicable laws". Guess what, there's plenty of laws that contradict this disclaimer. I assume Comcast is going to take steps to prevent it. The only way corporations have to say "sorry" is by money. Does firing the tech who let this slip (assuming thats what happened - I haven't read anything by Comcast that indicates they know what happened) make people feel better? I'd rather have the guy keep his job, and get better trained or proceedures put in place to prevent it. I also don't think the $10 is necessary, but its an acknowledgment of the seriousness of the situation. Before people blow a gasket saying how can $10 be "serious", multiply that by the number of viewers. To a company, that's serious.

1. They are claiming this isn't their fault, and that it was malicious

2. Cable TV isn't subject to the same rules as over the air broadcast

3. The FCC hasn't been all that good on collecting its fines.

If you ask any prude, you will find that they require that any person or exhibition related to sports be perfect. The athletes must never do anything the prudish define as immoral. The prudes consider athletes as the role model for their children and therefore the athletes must be perfect in their behavior. to everyone that's say "sex is normal", etc: Pretend for a sec you have a 8 year old daughter that's watching the Superbowl and see instead male parts. Tell me how you'd deal with this situation. And keep in mind, from what I read, it was a 30 second piece, which is more than enough time to caught a kid's attention.

I sincerely hope Comcast is able to find the Bozos that did this, fire them and prosecute them to the fullest extent of the law, what a total idiot prank!

But 10 bucks as credit is nothing compared to what a father/mother will have to do to deal with their 5, 6, 7, 8, 9 year old... Even the co-payment for a single child therapy session is far more than 10 bucks, and quite a few sessions may be needed in this situation.

Parents may have to field questions early...

But those questions were coming sooner or later. I think the lack of willingness of some parents to be open and honest with their kids about how things are in the 'real world' is more harmful than a few secs of flopping penis on TV. My parents were always willing to discuss anything with myself and my brother growing up. No topics were 'off limits'. We both turned out to be very well adjusted, independent, successful adults. Shocking isn't it.
