QuebecTorrent backs down to keep legal channels open for other torrent sites

The Canadian recording industry has been engaged in a legal battle with BitTorrent tracker QuebecTorrent since last year, demanding that the business shut down due to copyright violations on the site. The site originally declined to shut down but has now agreed to comply with a permanent injunction to do so which was issued by the Superior Court of Quebec. The entertainment industry in the country has said that this case sets precedent for other BitTorrent trackers but QuebecTorrent’s owner argues that this does not set precedent at all and that, in fact, the choice to comply with the injunction was made in part out of the desire to not set precedent in this area.

In this case, QuebecTorrent was facing an uphill battle against 30 large organizations with a lot of resources behind them. The tracker is also dealing with outdated copyright laws that remain on the books in Canada. QuebecTorrent knew that there was very little chance of winning this case and therefore opted to withdraw from the battle. This choice could mean that other BitTorrent trackers facing similar legal battles in the future may be able to obtain more success since no anti-torrent legal precedent has been set.

Google Trends indicates the site was getting about 20,000 to 25,000 users per day.

Those will just go elsewhere.

Also, the site didn't just "give in" to pressure. The court issued a permanent injunction to shut down. People ignore court orders like that at their own peril.
However, the pressure became too great and on July 9th QuebecTorrent was forced to close after it received a permanent injunction from the Superior Court of Quebec. The judgment reads:

ORDER the defendants Sébastien Brûlotte and Quebectorrent.com inc., their officers, administrators, employees, representatives, mandator as well as any person acting directly or indirectly on their behalf or according to their instructions, as well as to any person informed of the present injunction to immediately close the torrents on these website Quebectorrent and to refrain from being involved in any website using the bittorrent technology, peer to peer, or any other technology allowing the download of any work protected by copyright.

Just goes to show that the judges who make these kinds of rulings and issue these sorts of injunctions do not know their Internet asses from their technology elbows. That is more scary than any precedent, real or imagined, that may arise from this case.

Nah I wouldn't put too much into it. Quebec has always sort of been the black sheep of Canada. And IIRC their provincial level law is based on old French legal system, while the rest of the country of course adopted it's from the Brits.
Though that may only refer to their civil law and not their criminal law. It's been a long time since taking any Canadian history classes.
