Qualcomm's expected patent infringement fees cut in half

When a jury found Qualcomm guilty of patent infringement back in May, two legal issues remained. One was whether or not an import ban would be instituted and the other was whether the judge would award up to triple the amount of compensation ordered by a jury since the case was deemed “willful”. Both played out in favor of Broadcom with the ban approved and the judge ordering a double award. As it turned out, however, an unrelated case had made the double award legally void. The judge said that Broadcom could either accept the original jury award of almost $20 million or agree to a new trial in which the company would have to re-prove the patent infringement. Broadcom has decided to accept the amount. They plan to seek a permanent injunction against all Qualcomm chips found to violate the patent.

this is not patent troll lawsuit but an actual hardware chip being sued over patent violations. Broadcom was and is perfectly justified in seeking relief in this manner given qulcomm's aversion to settle it in a way consistent with patent law.

Common Sense Prevails

Broadcom was prudent to accept what was settled on the first time around instead of paying more legal and atty fees to rethink the prosecution of this case. Litigation is not cheap so it makes more sense to just take the money and run.
