Apple Wants Galaxy Nexus Banned in U.S.
As Global Patent Feud Continues to Bubble Over
by Karl Bode Monday 13-Feb-2012 tags: legal · business · wireless · hardware · wireless · Apple
Tipped by skj See Profile
Florian Mueller at Foss Patents notes that Apple has filed a preliminary injunction against the Galaxy Nexus, which Apple claims violates four Apple patents. The Nexus, launched late last year, is Apple's latest and greatest competitor in the smartphone wars, and was the first device to showcase Google's new Android 4.0 Ice Cream Sandwich OS. The four patents cover slide to unlock functionality, Siri-focused voice search technology, Apple's word completion patent, and a patent for "data tapping" (allows users to click on auto-linked phone numbers). Several of the technologies are already involved in legal disputes elsewhere -- slide to unlock is part of Apple's legal campaign in Germany, where a court denied Apple's attempt to have the device banned there.

Innovation?

It's good to see that tech companies are beginning to use the innovation of their lawyers legal capabilities as their primary market advantage. Who needs technological competition when we have lawyers?

Should fight it out in marketplace; not courts

Apple & Samsung have taken this battle to absurd lengths. All it does is drive the cost of smartphones ever higher as lawsuits drive up costs.

»news.yahoo.com/apple-launches-le···318.html

Apple and Samsung are waging more than 20 legal fights in at least 10 countries in their war for global leadership of smartphone and tablet markets.

Instead of in the courts they should just be fighting this out in the marketplace.

That would make sense though!

But as long as software patents are allowed to exist we will have crap like this. because slide to unlock is just such a product defining innovation.

Agreed. Apple however, started this absurd patent offensive against Samsung precisely because how fast they were losing market share against Android devices. Samsung was simply forced to fight back. Notice Microsoft is doing the same thing against Android device makers. One can only hope that this will introduce some sort of patent reform, but that's a pipe dream.

Apple started the war, however. Samsung is merely returning fire.

Many of the patents at the heart of these competition blocking measures should NEVER have been granted in the first place.

Just because you take someone else's idea, invention, patent, and then add ".... to a portable electronic device" on the end doesn't mean you deserve the patent!

Since the USPTO won't do it...

...it's up to society to show Apple that some of their patents are absurd. The way society can do that is to not only shun Apple products, but also make using Apple products a social faux pas.

Once-upon-a-time, not long ago, I urged my wife to use an Apple desktop or laptop, rather than a Windows box. No more. I don't like having Windows in the house, but Apple's entirely off the table. Nor will any phones or tablets either of us buy be Apple products. In conversation, when Apple or its products come up, I express distaste.

You are a prime example of an Apple Fanboi. Does Apple have you brainwashed with all their products that "they designed" and didn't "copy from others"?

I'm surprised they didn't get sued by The Roddenberry Foundation for copying his ideas, not to mention a handful of movies that have devices that function like an iPad.

Well after having an iphone 4, iphone 4s, droid charge, played with a nexus for a bit from a friend...

I prefer the iphone 4 and 4s. The droids software is better, but also buggy as hell. I got tired of crashes and whatnot.

Although I hate the icons that go from the left to the right... Going from android to ios is like going from xbox 360 to snes..

While I have never owned an Apple desktop or Laptop I did own a iPhone for awhile, after I got sick of the locked down buggy restrictive OS I dumped that as well and with all of these bullshit lawsuits I will never go back to them.

Personally I would love to know where Crapple gets off comparing there "Slide to Unlock" feature to the one on the Nexus (Which is part of the OS and as such Google not Samsung), there is no comparison, a Circle is not a slider, and the Circle unlocker on the Nexus also lets you take pictures while the one in iOS is nothing more then a 1 function left to right slider that only does unlock.

The same thing can be said about Siri, there is NOTHING like Siri in the OS that comes with the Nexus and what is there has been around LONG before Siri even came into existence and is part of previous Android OS's.

I just hope that this case gets a competent judge who throws this case out and fines Crapple a shitload of money so they learn a lesson, anything less and this crap will just continue to go on hurting the consumers at the expense of innovation.

Just a quick note, tap the button twice when going to unlock, it'll bring up quick controls for the audio and a camera button.

That being said, I won't be buying any more apple stuff and am trying to time a short sell on their stock.

Philosophy...

If you want to know why Apple is just blatantly greedy, you need look no further than Steve Jobs. As a contrast, look at Bill Gates. Gates has given over a BILLION dollars to charity to fight AIDS and other diseases around the world, to ease the suffering of millions of people. What did Jobs want to spend his money on? He was quoted saying he would, if needed, spend every penny Apple had (at that time they had about $40billion in the bank) to see Android buried. Steve Jobs was a megalomaniacal genius, not a nice guy. Apple continues that philosophy.

I hope they get laughed out of court on this one.

Don't conflate personal and corporate monies. Gates is more openly philanthropic and Apple has been horribly misusing its capital, but I don't believe you can easily conclude greed based on any of this.

Re: Philosophy...

As the CEO of a publicly traded corporations Jobs and Gates were both required to file personal financial statements with the SEC that are publicly available. I believe it's a well documented fact that Jobs gave little to charity though I'm not sure what that has to do with anything. After all Romney shows a large charitable giving but the vast majority of that is Mormon tithing which IMO highly distorts the value of such a figure.

Apple doesn't like to be sued

On the other hand, Motorola is suing Apple for use of its 3G patents that Apple thought it won't need to license as everybody else and is trying to cry a river of critical patents. Yet, common sense stuff is OK, because it is on Apple's portfolio? Double standard if you ask me

Apple is GREEDY

This is why I don't use apple products, over price pos. I refused to use them in 90's cause they over priced computers. I not fan of windows either but i can afford it and as a tech I can fix my own stuff (I can play my games I want too on windows without have setup dual boot system) I did have Ipod touch for music and ereader but when they started charge 30% using the software like bn, sony and others to buy ebooks I refused to use it now sold on ebay. I use my android phone for it now or kindle. I sick of apple greed if their own product can't stand on its own without doing this kind of thing then its proof of nothing but greed and I will not be use apple ever.

Time to buy a Galaxy Nexus

Apparently the Galaxy Nexus must be a real great phone. Or else Apple wouldn't be pulling this stunt.

Way back when Married with Children first aired, I never watched the show. Then a group went public to boycott married with Children. So of course I had to tune in to see why.
and I watched it loyally for it's entire run. Now it's looking like I just might have to try this phone out. As it seems to have Apple "afraid".
Like how I heard about linux, and decided to try it. As Microsoft seems to really think highly of it's windows platforms. By highly I mean $$$ they charge. So now I can live without windows, just fine.

Question is this: If I do buy the phone, and Apple manages to buy enough government/court types and get the phone banned, I'll still be able to use the phone until it breaks?

ROFL

Android phones have had three of those features for years.

Skype for PC has made numbers clickable for even longer probably.

Slide to unlock, really? That's worse than the 'buy it now' button.

Everyone who has filed patents for real technical innovations should find this insulting. The average person basing their perception on these frivolous cases probably thinks the patent office should be burned to the ground, and even though I've got my name on a few it's hard to disagree with them.

From an Apple Fanboy

My current phone is the iPhone 4 on Verizon. I like the iPhone for its ease of use and it doubles as an iPod. Plus, it's easy to sync with my MacBook Pro. I had an Android device when I had AT&T but quickly went back to iPhone.

I can see the merit of Apple's claim as Android devices are very similar in look and feel of iOS.

You don't know much about patents. It has to be "not obvious", and cannot be shown in prior art by others. As such, Apple's "look and feel" are most certainly not patentable.

But consider the source, fanboy.

It's a bunch of icons! To not be copyright infringement it has to be different by 20% estimation (This is how they measure rip offs, esp in the software field), so this is why Apple is going the route of look and feel. It's a dirty tactic.

nothing new..

might as well re-new the age old lawsuits against Microsoft for patent violations as well.. Remember those?

Obviously this is put to hardware makers, but I can't see how patent violations can be won if the tablet runs a completely different operating system (and has at least ONE significant hardware change in it's specifications). Maybe apple could have a word in edgewise if Samsung blatently promoted running IOS (hacked and unsupported) on it's tablets-- but that's not what's happening here, so APPLE need to tuck their lawyers between their tails before a court fines them for filing frivolous lawsuits, because that's what I would do if I were the judge besides use the filing application for toilet paper!

That is one of many in a never-ending surge of sexy Android phones which is why Apple is going after the Android OS itself here.

You don't need all these choices you need Apple, because they are the only ones who can do amazing things like touching a screen to unlock and dialing a number.

Yeah, but I don't see how they can take on the Chinese.

1. China doesn't give a crap what we think as long as we buy their stuff.

2. Apple's products are made in China too.

So, China gets to make Android "I-phone" killers up the wazzo, meanwhile Foxconn and other Chinese operations get to make Apple gear.

Protect it or lose it

These ludicrous legal fights may have more to do with the need for a company to protect its patents than to try to hurt the others.

If a company does not protect its own patents and lets others steal the ideas, i sets a precedent which makes it OK for anyone to use the ideas.

At the end of the day, the problem starts when the patent office accepts silly ideas such as sliding finger on a screen as a patentable idea.
