3G laptop customers complain of ringtones they can't use, didn't order...

AT&T has settled a class action lawsuit with consumers who say they were the victim of mysterious charges for ringtones and other content they never asked for. The settlement allows customers to claim refunds for any such charges incurred between Jan. 1, 2004, and May 30, 2008. AT&T nets a portion of income from these third party services, whose fees are often hidden or poorly explained. In some instances, mysterious ringtone fees have shown up on the bills of AT&T 3G laptop customers who can't use and didn't order them.

AT&T now requires that all users respond to such offers with a text message. The content providers must now also send users monthly un-subscription reminders. Users impacted by "cramming" on AT&T's network can make a refund request via this link. It won't be anywhere near as tasty as the $4.3 million lawyers are getting from the settlement, but so it goes...

Woopity freaking dooo.. In the process, ATT isn't punished and yields financial gain from doing said activity. Wow, that was a pointless lawsuit that made lawyers rich. ATT should have to pay a huge fine, including all interest and profits made from overcharging.

Read the Bill!

It shouldn't have happened at all but I am one to read all of my bills in detail. If I don't understand a charge or don't agree with something I call it in. Simple as that. Why wait and let it snowball?

Because most people arent as diligent as you are. Most just pay bills not even looking at their bill. Then 6 months later they call in wanting credit for service that they had paid for in the beginning crying that they never ordered.

I had this happen when I had a monthly subscription to a Cingular/ATT mobile phone application. I cancelled it after deciding I didn't use it enough, but they kept charging me for it. I would call and they would credit me and promise that they took it off but then next month it would still be there.

After going thru this for over half a year, I made one final call. I wasn't so nice about it this time but they got the message that I do pay attention to my bills and I wasn't just going to let this go. That fixed it, sad to say because a customer shouldn't have to do that. Don't know what the guy did that made it finally stop but why they didn't do it from my first call?

All the above. Also, LOTS of people call in and point out that a charge doesn't make sense, then AT&T claims it is proper, and the user is either not given enough information to refute it properly at that point (they claim it must be regular charges or something), or the user still contests it but AT&T refuses to deal with it. I think that's far more often than users just completely ignoring all charges.

Actually noone wants to freaking call ATT and wait 45 minutes just to talk to an indian that pretends to listen adn then transfer you to the cubicle next to him/her just to annoy you yet again and knowing you'll just hang up and forget about it... Its good money making buisness.. Who else are you gonna use for service in some areas? Tin Cans with strings work only soo good ya know..

Make notes about the best way to use the least amount of your time and resources, and the best way to use the most amount of their actual time and resources. Develop scripts that politely continue the conversation with them for a long time. For instance, figure out ways to get them to discuss matters for way over their allotted amount of time to talk to you, without getting transfered. When you've used up their allotment, and a lot of the hourly pay of that employee, make certain you get to continue using hourly pay of many other employees. When you are done costing them as much as they cost you for this and other unresolved events, if you were careful in what you discussed, the conversation could have already gotten to the point where they are about to fix at least something about the problems your account has.

That's what I do. I always make certain I use more of their money per issue than they are attempting to charge me for or have charged me for. That's how you can chip away at the monster successfully. The point is, they aren't allowed to steal from us without accountability.

It took my mother nearly a year to get SBC to remove a recurring charge for equipment she ordered, then cancelled before receiving it. The cancellation was in sufficient time to stop the shipment of the equipment, but she was billed for it, anyway. I don't know if it was the Cc: to the state PUC (this was telephone equipment), or the threat to switch DSL service away from SBC, but SBC finally cleared her bill.

Yes, I know that was SBC and this is AT&T; but the new AT&T is just the old SBC in new livery. And when SBC bought AT&T, they also bought all the liabilities that came with AT&T, as well as the assets.

NO! At&t Wireless should just ban cramers. One cram and you're out. Screw 'em. Want to get even with a cramer? File an FTC and PSC and Mail Fraud complaint against them. Mail fraud has to be investigated by postal inspectors. Also, you can file a donotcall.gov complaint. Also, don't forget to send your State's AG a complaint.

I used to get stupid texts from kids wanting to "chat". It cost me money so I wrote my carrier and the kids phones got terminated. I explained the mail fraud statute to my carrier and they dumped the college punks.

I found filing a complaint with the FCC actually works.

I filed a donotcall complaint, its been 8 month, no response.
I filed the same complaint with the FCC and they had contacted me by phone and mailed me a letter. Try making complaints @ fcc.gov.

Well, they don't want to benefit now that they've been spanked for it. This has gone on for years (and it's not just AT&T).

When I noticed a "strange" charge on my account AT&T (Cingular) resolved it quickly and painlessly at the time, however the "alleged" ringtone purchased was done so when the phone wasn't even active (out of the country at the time) so it wasn't a mere mistake. I was lucky. A lot had horror stories about their experiences and the cell carriers should have been more proactive in preventing it and stopping it once reported. They weren't and now the lawyers are the big beneficiaries. The carriers made bucks off of allowing it and I'm sure that had something to do with their lack of an aggressive response to stop it.

One doesn't have to view many commercials for these companies peddling ringtones and all their other crap to realize how sleazy they are.

when you click on those free ringtone flashing links on webpages. Nothing is free.

This was like those pr0n dialers for modems. Now, no one has 56k modems so ringtones are the next culprit.

Attorney Charges in Perspective

4,300,000.00 divided by average 250.00 an hour for work.

That comes out to.

17200 Hours of work or
716 days of work or
1.9ish years.

That would be straight work non stop. I'm in the wrong line of work.

Course if twenty people worked on it it works out to 35 days of total work non stop or 286 8 hour days.

$215,000.00 per person who worked on this. I'm sure the firm takes it's cut of course.

Still a nice chunk of change. I'm sure it's skewed a bit towards those who did the jaw work vs the underlings who ran all the paperwork and research etc.
