Does this mean you can sue AT&T again?

Remember AT&T's recent TOS changes? The ones that tried to explain the limitations of shoving dual HD and broadband down copper but really only confused the hell out of bloggers and users alike? Among other things, the changes gave AT&T the right to offer 30-day notice of price increases only when "commercially reasonable," while attempting to prevent you from suing AT&T. Unfortunately, some customers never got the e-mailed notice of the changes, because AT&T's spam filters filtered e-mails announcement of the changes as spam, according to the Consumerist.

An accident or caused by user?

Most webmail programs now have a user configurable spam filter built-in. Could the complaining party have caused the AT&T email to go in the spam folder by consistently marking emails coming from AT&T as spam?

When I mark emails as spam in Gmail, the system learns my preferences as to what is spam or not and places emails in folders accordingly.

And if that was the case here, what does that imply for contractual purposes? Can AT&T send emails that ignore users spam filter choices to make sure their spam gets thru?

P.S.> the BBR story mentions MANY customers, but when you go to the SOURCE article it says that only ONE person complained.
She added that the e-mail was successfully delivered to millions of other customers and the firm has received no other complaints.

"There is no evidence that this happened to anyone else, but we're continuing to look into it to make sure," she said.

He received it. It was put in spam folder. I, like many others, check my spam folder on a regular basis. Not daily, but a couple times a week, to see if something was placed in there by mistake. With the millions of AT&T customers, surely more than 1 would have noticed the problem and complained about it.

I can't speak for other domains..
But for the past few days I've gotten customer calls about yahoo dumping "almost" everything into Spam.
- Then the awkward confrontation, trying to talk them down from the ledge.

That's nice. But my account (with AT&T) is setup to delete SPAM before it ever gets to my inbox. So if their filter flags it as spam (which it did, accordint to what i have read), it deletes it before it ever gets to "my" spam folder......

I never received any email, nor have I ever marked any email in my at&t account as spam. If I had not read about the changes on this site, I wouldn't have known anything about them.

I would guess there are many other people who didn't get the email, but don't read sites like this to even know there were changes made to the TOS. Kind of hard to complain when you don't know anything about the changes.

Filter on by default

When my account was created, my spam filters were automatically turned on. Spam is hidden in the spam folder on ATT's server. You will see spam messages on the web interface, but POP and fetchmail clients will not. I turned off the filter because non-spam was also being hidden in the spam folder.

Long time problem

I've had AT&T DSL for one year now. I still find their e-mails in my junk folder all the time. I've marked them as not spam on multiple occasions but the problem continues. I've mentioned it to customer service to no avail. Oh well!
