Information Week points to the fact that a lawsuit was filed in Ohio court this week against Apple and AT&T for the companies' inability to deliver MMS functionality for the iPhone, despite the fact that several support documents refer to the functionality. Apple did alert customers to the fact that MMS via AT&T wouldn't be available until the end of the summer, but the lawsuit alleges "the disclaimer is written in a font so small that it is almost unreadable." This is the second lawsuit this month against the companies over lacking MMS support.

How did they make it so clear that everybody that owns an iPhone capable of MMS was aware that MMS was not currently available?

Please explain? I hope you don't pin your response on a keynote address that the Apple God gave 3 months ago. Because I am sure that every iPhone customer was sitting around listening to the Holy One speak.

The ones that really DO need to have their asses kicked is ATT, not apple.

I agree that AT&T is the one responsible. It's not Apple. But to assume that everybody who owns and iPhone is aware of MMS not being available is nuts.

The only announcement was at the keynote. Basically very few people sit around and watch the speech made during the introduction of the iPhone. But all of the advertising shows MSM feature being available. I actually believe Apple had a commercial where someone was obviously using MMS because they were sending a picture through the text messaging feature.

I for one hope AT&T gets slammed to the wall for this. AT&T is one shitty ass company and should be sued at every opportunity.

Why would ANYONE sue for not having MMS !?

MMS is a ploy from the cell carriers to extract more $$ from dumb users who don't know what e-mail is.

I was extremely happy when Apple first introduced the iPhone as there was no MMS blood sucking feature included. Now, it looks like Apple caved to the carrier pressure to add it in.

Again, no sane consumer shoud actually WANT MMS on their phone just as no sane consumer should go with a CDMA provider when a GSM alternative is available.

I almost agree with you, except that we've been paying for data plans which are supposed to include MMS. If I had not been paying so much all this time, I wouldn't really care about MMS, but now I feel like they owe it to me, even if I never use it.

I agree, but the fact remains I have been paying for it all this time, and they haven't given it to me, which is even worse.
MMS might be free with AT&T, but with Robbers and Fido(part of Robbers empire since 2004) MMS is not free at all. You get a nice charge for every MMS sent OR received.

I think what he means is, when you purchase an unlimited text messaging plan, it INCLUDES MMS messaging. Since the iPhone is not able to use this, he should be paying less for a plan that doesn't include MMS.

Which "providers"? Sprint? Yeah, you get what you pay for when it comes to that. Sprint may have the non-retention department customer service backing it, but the coverage map doesn't give any insight into how many holes "The Now Network" has, at least on the west coast. I'd never buy anything from Sprint again after dealing with a rude retention rep that hung up on me. Verizon is the most expensive provider in the United States, so I have no idea why "provider" is plural in your post. Not to mention the fact that Verizon turned down the phone to begin with, so Apple tried to go CDMA.

AT&T works fine for where I go. It doesn't matter where I am, I always know I'll have 5 bars backing my iPhone. I don't see why people continue to cite that CDMA providers provide better service, when you probably aren't even a customer with a GSM carrier. AT&T has improved network coverage tenfold in the cities I go to. I can drive down I-15 from Vegas to California, and always have 3G with 5 bars. I can drive all the way through the hill of Los Angeles up to Santa Clarita, and always have 5 bars. When I had Sprint, it was either roaming on Verizon, barely hanging on to 1X (which was most of the time), or it actually working. Sprint works great when it actually works, I'll say that much.

With that said, if the iPhone was with Verizon, I'd probably switch over, but if they had a major flood of iPhones like AT&T has, I'd be willing to bet everything wouldn't be as peachy as people on here seem to believe. AT&T is being forced to put up new towers in areas that already have coverage, or adding more expensive backhaul to towers, because the network is so saturated with a phone that uses a ton of data.

if you want your conversations and data to remain private over the air then CDMA is the way to go.

At least READ the source before trying to make a point. The vulnerability only occurs if your phone is a 2G/3G hybrid and your provider is a 2G/3G hybrid as well. When the phone transitions from a 3G cell to a 2G cell, the man in the middle attack is valid. However, when the user is in a 3G only network or uses only a 3G phone, there is no vulnerability. The upcoming Bell/Telus 3G network is such an example. My point still stangs : 3G UMTS is not vulnerable to such attack.

at&t and tmobile are 2g/3g hybrids...they can't really offer you a 3g only phone or you will be without coverage daily ... cdma is still the choice for ota security in the usa.

This is the dumbest post Ive seen on the MMS issue todate. Get a clue man. So you nor not sane if you want MMS on your phone? There is no extra charge for MMS is goes with any texting package that you have. Apple did not cave, this is a feature that has been on crap phone for years now. As for CDMA to GSM comparison, not really sure what that has to do with this thread..Good god some people!!!

See my post above. MMS costs $$ per each message in addition to the data charge. They might be free with AT&T, but not with Robbers/Fido and many other carriers. Just like SMS is a cash cow for carriers, so is MMS.

As for CDMA, my beef is not with the technology, but rather with the restrictions being imposed on the consumer : can not change phone without the carrier's authorization, can not ACTIVATE phone that the carrier does not approve, crap ass selection of phones since all the latests ones are always GSM/HSPA(in general).

I guess I am "insane" for using MMS to send a picture to my friends' phones. I'm not sure how else to get a picture directly to their phones since they cannot receive emails.

By the way, I don't pay anything extra for sending an MMS. Maybe you just have a crappy carrier?

I'm not sure why you are trashing CDMA since it has been shown to offer much better reception than GSM. I have been in several places (parking garages in particular) where my friends' GSM phones have no signal, but my CDMA phone works just fine.

Then again, I am insane.

For the record, this has nothing really to do with GSM Vs. CDMA. Your signal is based on how well your area is equipped by your service provider.

Your area may be specifically covered by CDMA better than GSM, but it's just as easily flipped the opposite in other cities/areas etc. For instance, I can get a signal on the GSM network in my area practically anywhere. Including the long highways between the major cities. Whereas the CDMA network is horrible and does not cover nearly as well.

Putting all that aside, one of the key components is your phone. The brand/quality of your phone absolutely makes a difference in how well you pick up either signal regardless of coverage.

Maybe the problem isn't with the fee's. The problem is with your package?

MMS is free on several of the packages available from Rogers. So I'm not sure where you're getting your information from.

In fact, their latest Email/TXT/MSN/MMS package is $35/month with nearly all of the QWERTY phones that are so popular right now.

Maybe you need to do a little more research

Edit: Forgot to mention it's unlimited Email/TXT/MSN/MMS.

I use MMS every so often. I also use CDMA. Some people have dumbphones that can only do MMS, so it works out. These days, all the messaging plans I know of on mainstream carriers bundle MMS with SMS.

Why is apple being sued. MMS works fine on my 3Gs. Apple's product works fine as advertised. ATT on the other hand is not allowing MMS to its customers. Im still not sure this warrants a lawsuit.
T-Mobile on the other hand lets me MMS all i want.

They'll probably not turn it on and tell us to screw off

If they had any intention of providing the service it would of happened by now. The only good thing is they're probably going to provide it for free since they're taking their sweet time getting it going.

I'm fairly sure Apple has had it with AT&T and hopefully soon Verizon will carry the phone. Verizon has stated they have no problems carrying the iPhone should it come to them now.

And before someone puts in Tmobile, please their 3g network is about 1% the size of AT&T's and most of it's really 2.5g edge.

iPhone users don't need mms?? What??? Not every one has a data plan. Not everyone can check emails on there phone. And not everyone can email u a picture. Mms is supposed to be quick and simple. The phone number@service provider crap doesn't do justice. It's a pain in the ass to memorize all the email coded and phone numbers. This is old technology that should have been implemented on the first release. Evry other phone has the capabilites even the pay as u go phones.

Time for AT&T&Apple (ATTA, catchy right?), to say the iPhone on ATT will NEVER have MMS because its a legacy technology, and that benefits the consumer by not having legacy techonology in their phone so they can ride the future

They tried to use that excuse.. but it didn't work. Since MMS is already running on AT&T network, why can't the iPhone send and recieve MMS messages?

But they are grandfathering/retiring MMS on ATT.

iPhone MMS

Yes it, once again, seems that the "Death Star" doesn't quite know what to do with us iPhone users. First it's boatloads of just plain olde data usage bringing it's (flaky) 3G network to it's knees. iPhone's aren't Blackberry's, and it seems that ATT had no idea what the iPhone would do to it's network. Granted, it's nice having "unlimited" data for $30 a month, whereas other carriers charge by the Mb...Telstra, Vodaphone, Rogers, Orange comes to mind here. But...MMS..Jeeze..is it THAT hard ATT? My sis-in-law's Moto V3xx does MMS...as other phones..Blackberry's too.

Oh well, guess I'll just continue to use my enV3 for the time being...thank you Verizon...

a friend of mine has a phone that has Wi-Fi, and bluetooth, and you can use both to load ringtones. There are different bluetooth versions. For example, my cell phone has the lower version which only supports headsets and other stuff like that.

At&t finally announced a launch date of september 25th for mms on the iphone. How funny would it be if it went to trial and the trial date was after the launch. I can see it now:
