'We are not traffic cops,' says ISP CEO

iiNet, one of Australia's largest ISPs, has been sued by seven Hollywood studios for failing to stop the transfer of pirated content across their network. According to ComputerWorld, iiNet says the studios expect the impossible, company CEO Michael Malone telling the website "we are not traffic cops." "We can't stand in the middle of it and stop the individual items that might be against the law," he says. "These guys are asking us to be judge, jury and executioner." As we noted last week, Malone's company is participating in Australia's plans for national, mandatory internet filters to highlight how they won't work.

Would Hollywood sue the Post Office

for not stopping pirated copies of movies being delivered by mail? No of course not. Can someone explain the difference?

People realize how difficult it would be for the Post Office to have to prove everything that goes through the mail is legitimate, but too many people are still under the delusion that all ISPs have to do is hook it up a few boxes, and suddenly all piracy will end.

And this is why the **AAs are often referred to as the MAFIAA.

In some ways this action by them is remarkably similar to the French SPPF suing Limewire, Morpheus, Vuze and SourceForge. And equally likely to fail as well.

Your definition of failing in this matter is different than mine. The fact that they are EVEN ABLE to sue is a "win" for them! Perhaps they may "loose" the ruling in this case, it still won't prevent them from targeting the next guy... and sick their lobbied bulldogs after them!

It's kind of like spear-fishing! The hungry one is going to make a LOT of misses, but eventually he'll hit the jackpot... making his efforts worth wild! Rinse, and repeat!

And money - for both sides.

Sure, The MAFIAA can afford it - but the ISPs cannot afford to lose money on legal fees. Eventually they'll just resort to giving up and letting the MAFIAA have what they want.. "just don't sue us".

Real mob: "do what we tell you to or we'll break your legs"
MAFIAA: "do what we tell you to or we'll break your wallet"

Same difference, same end result. (eventually)

Governments need to step in and stop this by outlawing frivolous lawsuits like this.

Ok, so college students are the unwilling, primary investors in the RIAA's cause, but I think that the ISP's have a ton of money, and a lot of resources. If this was not the case, we'd already be knee deep in the same crap that the much smaller ISP's in Australia are involved in.

Comcast, AT&T, and Verizon are not as easy to push around. But that is the only thing saving us all from a disaster at the hands of the RIAA.

Yep. You get sued if you try and fail. You get sued if you stop something incorrectly; You get sued if you fail to stop something. In other words, you lose all around.

I stopped buying music long ago, when the RIAA started suing [everyone]. I guess I'll stop buying movies now.

I still go to the movies, but if I want to watch a movie a second time then I just download it. I only buy movies which are worth watching several times over, and that does not happen very often at all, only have 20 purchased movies over the course of 5 years.

Well you are part of the problem then. If it was worth watch logically it is worth paying for. If the movie is so crappy it's not worth paying for then why bother downloading and watching it. That's like eating a plate of dog crap because it was free.

Sorry, but if movies and TV shows are that bad they aren't worth what the studios charge then yous peak wth your wallet and you don't buy. That doesn't mean you steal or "copy". The fact is if a millon people steal a movie then they aren't sending the message that the movie is crap and has no value they are giving the studios the exact OPPOSITE impression. And this in turn gives the studios the supposed ammo they need to go after downloaders. Anyone that says they download to "get back" at the studios are either delusional, lying or just plain stupid.

No longer need this business model

and the only people who have the right to get paid for their product can no longer control said products after the sale and now they want the government to step in and do their job for them. I say OK! and then bill the RIAA and the MPAA for operating (failed) business model.
Bill them for costs, hiring, training, distributin of product, -and- cost accounting.
In short, if the lawyers want to "solve" this business model crisis, make it expensive to do so. Nobody said the government handouts had to be free...
