Dark Reading has more detail on a new law in California that tries to tackle Wi-Fi Freeloading and unsecured wireless routers. The bill, passed in the State Senate yesterday and soon to be signed by Governor Schwarzenegger, will require all vendors to put stickers on routers made after October 2007, warning users to password protect the devices.

It doesn't seem to clarify the muddy legal wording of existing laws when it comes to grabbing some free bandwidth. Both Section 502 of the California penal code and the Federal Computer Fraud and Abuse Act "prohibit the intentional access to a computer without authorization." But are Wi-Fi freeloaders accessing the user's computer, or just the router? And does the word "computer" apply to router?

Daily Wireless picks out the choice quotes from web-coverage of the bill. "The question is, can we legislate away consumer idiocy?" asks Paul Debeasi, a wireless industry analyst with the Burton Group based in Midvale, Utah. "On the face of it, it's like cautioning the coffee drinker that the beverage is hot," said another Wi-Fi industry analyst. "It seems like a solution in search of a problem."

Ive been cantennaing off of 3 neighbors routers all year now. I get 30gigs a day of movie goodness including all of schawtzies T flicks. Its great. I have over 9300 movie files and 6500 Tv episodes. I ran out of drive letters so I have multiple pc's storing what I collectively call mini block buster video. 29.95/month is a pittance for my own access but I mooch for solely one reason. Deep pocket bastards are filing extortion lawsuits perverting the system with no intention of actually going to court. Fine, I dont have a conscience either so I respond by perverting the equipment use to evade their detection. They may catch the neighbors but na na na na na, they'll never catch me. And extorting innocent neighbors will be more bad press for them as I continue to help keep P2P strong and proud.

Mod Note If the grammar and spelling were as atrocious as in this one, I can understand why it never saw the light of day. If the post was just a rant and didn't add to the discussion, it probably went bye-bye also. As for nazi sencors (sic) and free speach (sic), read the site rules, Constitution doesn't apply to private endeavors, that prohibition is only placed against the Government, not individuals. Please learn how the Constitution is applied in real life? And in reality, I know of no mod here who is a member of the Nazi party - got some ACLU junkies hanging around, but no real Nazis.

The government can be trusted to protect it self, and has the tax payers money to continue its fight in the courts until the law is passed. even if the law in not to its favor we will ignore it anyway. Bush holds the trump card on the law according to wire tapping etc.

Heh... every time I am in CA I see these stickers that say something like "Chemicals known to the State of California are in this and they will cause cancer and kill you." This approach reminds me of that. I am sure just like the cancer stickers, this new sticker will be equally useless

I agree. The router already ships with documentation which (usually) screams about enabling WPA or some kind of protection.

Not to mention, Windows XP SP2 clients will also alert the client every time they connect to an "insecure" AP.

Receiving transmissions

Is there not a federal law that says citizens are allowed to receive any transmission. I have heard this argument be used in stated where radar detectors are illegal. People would try and use the fed law to get around state laws. If that is true then I can receive any wifi I want as long as I don't crack or decrypt.

It's not illegal to listen to cell phones, only to record them for anything but personal use. If I record your cell phone conversation and then through it up on youtube then I'm in trouble. If I record your cell phone conversation for a personal chuckle at home, well then I'm just a strange person.

Recording as a 3rd party is wire tappings period.. no matter how you justify it. All states have at least a 1 part rule, about 10 or less have the 2-party rule. NONE have a 3rd party rule.

Tapping into conversations AND "recording" them 'for any purpose' is a ticket to being bubba's wife.

According to your post, it's ok as long as you don't get caught.

In Ohio its legal for you to record any phone convo you want as long as ONE party on the phone knows. So basically I could be talking to you and 2 other people on the phone, and as long as I would know (duh) I could record your convo under Ohio law. And in Ohio it protects me. Nothing else you could do- under our laws.

you can receive any radio transmission you want no law can stop you. weather or not the transmission is of any use is another story(most digital cell calls have some encryption, usless without the two phones making the said call).

Yes, that law exists. The problem comes when you have to send a signal back to the router in order to request a page. That's where you cross the line between receiving and accessing.

Along with extremely liberal judges, that have contributed to this lawsuit-happy society we have today. You put stickers telling people the most stupidly common-sensical things and they become dependent on the government to tell them what's good or bad. Then they sue when the hot coffe burns them because there wasn't a label saying hot things burn.

Next thing you know, someone will sue because the wireless router didn't have a label saying their radio signal can be picked up by the neighbor's antenna too.

Easy there, sport. Is it liberalism or Conservatism that advocates everyone is entitled to everything and nothing is your fault?

I made a point to use "Extremely" because a balance of liberalism and conservatism is always good, but extremes are not.

When an article comes up about how someone can't watch porn in their own home because conservative judges ruled it's illegal, then we can talk about how they ruined this country. For now, let's stick to the issue at hand.

If I were to open up my router, you'd have to work pretty hard to get in my laptops, but you could go hit MySpace with ease.

why the fuss over free wifi?

If all a user connecting wirelessly wants is quick easy internet access, then what's the big deal, and why is everyone suddenly complaining about open wifi? If I ever get my own wireless setup, I'll gladly make it publicly available to anyone in range, even going so far as to put up an outside antenna for maximum range. any wireless user wishing to connect to my network is more than welcome to do so, regardless of whether they want to surf the web, or browse my network and enjoy the over 70 gigabytes of audio/video content I purposely share over my network. So because I would run a completely open wifi connection, am I now some sort of horrible person? It makes no sense. as long as the persons connecting are browsing the web or the local network, then who cares if the wifi is open? Why can't we just enjoy the technology we have instead of always complaining about it?

Simple Question?

Why don't WiFi vendors do what some DSL/Cable providers do, and lock the unit down with a password out of the box, and have that password written on the unit? Seems like an easy solution to me, and it doesn't require the Government to get involved.

This law is an outdated law from the World War II error prohibiting the rape of the people trying to crack the german/japanese encryption.

As far as the sticker, California has always been able to put a smile on my face with the dumbest "rules" I have seen. If they could take your child away and raise them the "proper way" they would. California politicians seem to score points by looking like they are somehow making you more safe. No other state would this actually fly.

Seriously ever thing that's been going on lately is really crazy. I would love....just love it they made you get a licence to own a computer. Seriously it would make life a lot easier. there would be less stupid shit on the internet, less virus and all that because people with computers would have some basic knowledge and it would get nipped in the butt. but on the other hand its just the government limiting the way you can potentially hurt yourself.. in 10 years you wont be able to smack yourself in the forehead with out breaking a law

not sure if anyone mentioned this, but many do use the default settings for the password. for example my neighbors is password protected - admin is the password. I told her about it and she didn't think her WAN was available outside of her home

If the manufacturer were to design the installation software so it would pre-set all the functions in your PC and all you need to do is find the "Enter Key" it might help.
When it was finished it would say-"HERE'S YOUR SIGN".

We who frequent this and other tech type forums know what's up, but have you any idea how many PC owners have NO CLUE as to how their PC works.

There are people who own and use Hughes Satellite Dish Internet and have no clue as to what satellite or transponder they are on, nor any other pertenent info about their system.

The average PC owner knows what to click to IM or email and how to get to EBay and the home Shopping Network. THATS IT.

This technology is way above the average users head. YES,WAY.
