Class Action nets users $45
(old news - 11:45AM Saturday Jan 03 2004)
tags: legal · wireless
Many existing and former Verizon Wireless customers will be entitled to credits (as high as $45) from a class-action lawsuit against the company filed back in 2000. The suit alleges the company poorly explained fees and charges, misled consumers as to the terms of their roaming agreements, and improperly billed some users. According to this Detroit News article, Verizon has settled the suit with customers, but denies having done anything wrong. Discussion of cellphone providers and plans can always be found in our mobile phone forum.

Hmm...

Verizon has settled the suit with customers, but denies having done anything wrong.
Why doesn't that surprise me? I wonder if this will spur people in PA to try and get the $2 billion that Verizon stole from them back somehow...

I've seen similar verbiage in every class action settlement that has landed in my mailbox over the past 10 years (none of which were from Verizon).

Verizon WIRELESS is not the same as Verizon the RBOC. In fact, Verizon the RBOC only owns half of VW: Vodaphone owns the other half.

Please get your companies straight before unloading both barrels. Trust me, as I live in PA, I want my $2B back as much as you do.

I wouldn't be so sure about charging more for the same services...not only are they the best provider out there in many areas of the nation...but now that the new law has been passed so that you can take your number anywhere, there is a lot of open places for businesses; some not as reliable, some won't even be as reliable but that's a chance you take.

NOBODY has service as good as verizon wireless. Other companies claim they do. So what about a lawsuit. I have never had problems with my bill,or my service.

Re: Hey

Having had Verizon wireless I wholeheartedly disagree with your claims of Verizon superiority. I had them, they sucked. Mistakes in billing, bad CS, dropped calls, limited service areas...they were a nightmare.

Just wanted to jump in myself and give a big thumbs up to the Verizon wireless network. I used to have AT&T, liked the no roaming no long distance but it seemed like I was always looking for a good cell. With VZ, I don't recall a time where I have not been able to receive a signal. Signal is clear and no billing issues (so far )

Re: Hey

I found Alltel Wireless to be much better then Verizon Wireless in the Tampa Bay area. I actually made a phone call, on Alltel, when I was in Tampa. I was able to drive to Lake City, FL which about 300 miles away without getting dropped! My signal didn't fade, and I don't have an external antenna either, Go Alltel!

Not to mention I have 1000 peak minutes, unlimited nights, weekends, text messaging, long distance, and mobile to mobile for $39.95 a month with the whole state of Florida being my local area. Yes, you read correctly, unlimited on all those services above! Have a look: »www.alltel.com/promotions/wirele···dex.html

I attempted the same thing with but Cingular and Verizon and I got dropped about 5 times with each in Sumter County and Alachua County.

Yes I know, I use the cell phone entirely too much, nearly 5,000 minutes a month total.

There is only ONE winner in a "Class Action" suit

...and that would be the lawyers representing the plaintiff class.

The lawyers get 20% to 40% of any settlement in most cases since they work on a "contingency basis". So, if there are 5 million consumers in this class, multiplied by $45, that settlement would be about $225 Million. At 30%, the law firm[s] get $67.5 million, and each consumer gets (about) $45 in cash/credit.

What a joke. Moreover, since Verizon is such a big company, and since this action dates back to 1991 (156 Months ago), even the $225 Million figure is misleading. There is a finance model called Net Present Value (NPV). Basically, say a can of cola cost 10 cents in 1970, and now it cost $1, means my $1 could buy 10 times more 34 years ago. That $1 was more valuable then than now. So the $225 Million that Verizon ripped consumers off for in 1991 is now really only worth about $173 Million (at 2% inflation/yr). There do not seem to be any punitive damages in this settlement, since Verizon can still claim "no wrong doing", so it was in essence a zero interest $225 loan consumers gave Verizon during that time period, where only $173 Million had to be paid back (only because they got caught)

Have fun with your $45.

Re: There is only ONE winner in a "Class Action" s

ahh, but it makes people feel better. Who cares that some sleazy lawyer walks off with enough money to buy a small-medium sized country, money which is financed by the customers via price increases.

the lawyer gets rich

the customer gets a trinket and the satisfaction of sticking it to the man.

the company gets off without having to admit fault

Everybody wins... everyone except for those of us who have half a brain and see class action as the sham it is.

That alone should make it interesting to figure out who is eligible for what. Since 1991, what is currently Verizon Wireless in the Detroit area was Cellular One and then Airtouch Cellular (which becomes more even more interesting, since the Verizon suit looks remarkably similar to one that Airtouch settled in 1996). Then there's the Bell Atlantic Mobile account (not in the Detroit area) that I had in 1993 and 1994...

They should be sued again

Verizon's fees and charges are STILL poorly explained - I'll frequently hear different reps tell me different charges for the same thing. And their charging algorithms for airtime are extremely difficult to understand. None of this stuff is on their website. And it's not surprising when they overcharge given that a lot of their own employees don't understand their rates and how they are implemented or interpreted.

I have yet to find a subscriber who can go through their itemized Verizon cellular bill and understand everything that's on there.

They should be sued again.

disagree... These kind of comments will be found with every service provider by at least one or more person. You will simply take your business elsewere... I personally have had Verizon for over 4 years, out in the sticks and have never once had a minute of trouble...

Happy with Verizon

I have had Verizon wireless for almost 2 years now and never had a problem with customer service, billing, or lack of calling areas. In April my contract with Verizon is up and I will be definitely signing up for another 2 years with Verizon.

I use to have Sprint Wireless before switching to Verizon. I do have to say Sprint Wireless sucks. Sprints customer service has allot to be desired. The calling area for Sprint is small. Driving from western New Jersey to New York City, my Sprint phone dropped calls 10 times due to lack of signal area. When I drove from New Jersey to Kentucky my Verizon phone dropped a signal only 1 time.

I am sure many people had problems with Verizon or else there wouldn't of been a lawsuit. As with all companies, people will have bad and good experiences. I never knew there was even a lawsuit until I got a email saying what the result of the lawsuit was. Doesn't matter to me if I get anything from the lawsuit or not cause I am very happy with them at the moment.

Re: Happy with Verizon

I can understand your point of view. I use Verizon for all my telecom needs and I am content. However, even if you are and have been happy, would be good to stick together and support the apparently many consumers who did get taken by getting your $$$ and leting verizon know the consumers are sticking together. That is how we all will get the best bang for our dollar. Just a thought.

AT&T Should be next

When I was in an AT&T covered area, I was charged roaming from the time when i took the phone out of the box. They sent me a nokia 6800 and it was set to take the strongest signal. Well when I'm right next to a cigular tower, even though the att signal is perfect, the phone automatically switches to cingular. When this happens AT&T can then charge me for every minute i use. If I ordered AT&T service and I can pick it up, there should be no reason it should change without warning to charge roaming. I argued with some girl on the phone who obviously was on her rag, because she was very stupid, and she offered only to take half the charges off. I then said, HEY B#TCH, If you can take half the charges off then you are admitting that ATT ripped me off and you can take all the charges off. She kept refusing so I called back. Then a guy answered and he took off all the charges. AT&T is heading in the direction of a class action lawsuit because I bet there are many people who got charged roaming and should not have.

Re: Verizon Owes me Money

You need to speak to the supervisor of billing. If your persuaded not to, demand that you want to speak to one. Explain your problem to the supervisor and that you want your money immediately. If the supervisor tries to give you the runaround, tell him/her that you will be contacting the State Attorney General if you don't get your money. More times than not they will return your money.

Remember to get the name's of every person you speak to, the time and the day you spoke to them. This way if you still run into a problem you have those people to fall back on. Also if you end up filing a complaint with the State Attorney General, you can give the names of the people you spoke to. One more thing you can also do is contact your local t.v. station. I know the t.v. station like ABC has a complaint department for people who have problems similar like yours.

Good Luck

att class action

has anyone had a problem with AT&T Wireless. I had a problem where the were supposed to issue me a credit and did not. They then in turn turned off my service. I obtained service from another carrier and now they are trying to charge me a termination fee.

I was wondering if there were any class action lawsuits relating to this issue.
