The Rise of the Super-DMCA
Illegal to own information on cable theft?
(old news - 03:07PM Wednesday Apr 09 2003)
tags: legislation
Debate over new "Super-DMCA" legislation, which some believe could make things like firewalls or encryption a criminal offense, has grown to a fevered pitch among legal analysts and privacy advocates. Last week a website named Freedom-To-Tinker, run by a Princeton professor, got many up in arms by suggesting that a new batch of legislation making its way through several states (proposed by the MPAA) was a horribly worded monster of a law that could make many common technologies illegal.

The MPAA first drafted a "model" version of the bill, and has been busy pushing it through the various state's legislative processes. A list of the states, and the bills, can be found here.

It's the width and breadth of the language contained in the bills that has most analysts (both technical and legal) worried. The existing DMCA laws already are begging for revisions, due to their confusing and malleable application (ever think it could apply to printer cartridges?), and these new variations don't appear to make things any simpler. In fact many people are still trying to figure out what the new Super-DMCA laws would solve exactly.

For example, most variants of this bill would make it illegal to "conceal from a communication service provider ... the existence or place of origin or destination of any communication". Does this include firewalls? Encrypted web-mail services? NAT? Web Caching? Virtual private networks? Anonymous surfing tools?

Many argue that you aren’t truly hidden from view when you use many of these technologies, since your ISP is still aware of which IP address the communication originated, and who owns it. They also argue it's surely not the bill's intent to ban such common-place technology. But it's difficult to argue that the bills don't occasionally veer into the land of absurdity.

Section 6(a)(3) of the Texas variant of this same legislation says you can't even possess information about how to get around cable theft protection systems.

The bills as they stand are being passed off by the MPAA as a means to ban cable TV descramblers, and secure the infrastructure of cyberspace while crushing piracy, if the organization's synopsis of the bills (.pdf file) is any indication. The MPAA has also been circulating this one page lobbying flyer (pdf copy) to help drum up support for the idea.

If you examine the original model language draft (rtf file) of the legislation, it would appear to make it clear that the bill would only make concealment illegal if the owner of the technology "commits an offense... knowingly and with the intent to defraud a communication service provider."

But the road to hell is paved with good intentions, and Edward Felten, the Freedom to Tinker website operator, reminds people digesting the legislation that "citizens have to live with the consequences of well-intentioned but poorly drafted laws". Not all the variations of the legislation are very clear that "criminal intent" is necessary in order to prosecute.

In Colorado, the bill was not received well, amd a revised version isn't making critics any happier. Senator Jim Isgar apparently worked hard to rework the language, making "criminal intent" a primary sticking point. However the bill still has before opponents stop sweating. Among other oddities, the bill would still make it illegal to tell another person how to find or operate a p2p client.

This legislation is certainly aiming for cable pirates and college student Bob, viewing illegal films and listening to pirated Eminem mp3's on his i-Mac, but it's certainly liable to catch a few others in its broad and seemingly sloppy cross-fire.

What bull! If this happens the DMCA and RIAA and other websites of that nature will be hacked and down in less than a day. At least I'm pretty sure the government won't pass this...

It's been this way for quite some time now. And I doubt that anything will change unless someone can bring about loosening the grip corporate dollars have on our 'elected' officials.

Doesn't matter squat if I realized it.

Your Republic is supposed to be the model for democracy. Pretty pi$$ poor model IMO.

And this is what your administration is trying to shove up the a$$es of everyone in the Middle East? Corporate interests above Liberty and Freedom? Bahhh..

How many times do they get to crap on your head before it offends you?
Or are you status quo content with your 43" plasma TV?

It's a MPAA Monopoly

So they want to have contorl over anything technology related, so that would constititue a monopoly, therefore making it illegal and ridding the problem. Oh wait, it's the MPAA, they can make a law making them exempt.

What about corp servers, no firewall for them? Ah?

What I'm gonna do? Take the firewall of our corp. server so anyone could log in and change web pages to their needs? So any military and gov server will be hacked due to the law that it is illegal to have a firewall? Any 12 year old kid will be able to aim and fire the missiles. Then every hacker will have a backup of Pentagon top secret documents.

and my cd's to!

See? They take it bit by bit

This is how it works! If this was part of the *original* DMCA, it would of caused the whole bill to go down in flames (That would of kicked ass...)

... but, they pass first one bit, and then once people have 'accepted' it, they come in with the follow up, and take more....

Your freedoms and your rights are never taken from you all at once... they take them bit by bit... By the time Joe Sixpack wakes up to the fact that hey, everything is criminal, it's too late...

It's so annoying. Legislators who are SO BOUGHT AND PAID FOR as to ever support this type of crap should be considered criminals and locked up.

But no.. Instead this will pass. If not the first time, then the next time, or the next.

It's so frustrating watching our non-democracy at work.

You will have to pry my firewall from my cold dead fingers.

Im contacting my State Representatives about this, as well as beginning a petition for all to sign who believe that self-defense of their computers is a right. I will drag my ass down one block after another till my feet explode if thats what it takes.
Where I live it is legal to carry a sidearm. It will also remain legal to protect ones own system. Period...end of story

If they can't pass it outright...

They will just tack it onto the fine print of some other non-related bill.
[HR#6969] $2.5 million for study of groundhog mating habits and oh, by the way CD/DVD burners are now illegal to buy, sell, manufacture, or own.

This is how many things like this get passed, and it's a common practice that should be outlawed before any other legislation is passed for anything.

Damn skippy -- that is how many things get passed. I love it when they tack them onto the budget bills, so that if you don't vote for it then you are "Voting to shut down the government!"

Should've known

Should've known that electing a dumb ass blonde as Governor would cause stuff like this. Never heard a word about this here in Michigan until the day before it passed! This bill makes it illegal to hide, disguise, conceal or otherwise mask any of your info. What is this world coming to? I thought government was all for individual security?

Sheer Idiocy

As the American home becomes more computer literate, the concept of having a single computer in a household becomes more remote.
Having a connection to the internet through use of a single computer is a dying concept.
Routers are now accepted by DSL providers. Multiple logins have almost always been prohibited by the ISP's. To prevent the use of personal routers or Internet Connection Sharing (ICS) both of which act to "conceal" the IP address would be much more disruptive to modern families than legislators realize.
This legislative effort needs to BE STOPPED.

You still have 1 IP adress .. your main router / server so they still know who you are.. either way to geth rid of firewalls, NAT, and then this new palmbalmo or how ever you spell it chip from intel and microsoft with there new os that are out to control everything anyways.. either way were all being hit from all directions. and it's pretty sad.. i will move to linux and never look back.. at least linux doesn't by default open ports in your computer which the government can hack into like windows does.. just do a scan on grc.com and you'll find at least a net bios, and RPC port open in windows xp and 2k.. it's really pathetic what these people are doing to all of us.. we really have no democracy.. were just as communist as russia, china and all the rest.. just our leaders hide it better.

Actually we are on the other side of communist. In the US now, our corporations and rich people own and control the government. In communist countries, the government owns and controls the corporations.

The companies want access to your computer, so they can see what you have and scare you into deleting it. Firewalls block the ability for companies to access your information. Make firewalls illegal, what's left? We can't trust MS for the security to keep the RIAA/MPAA out of searching my disk drive for music. Looks like I might be on my way to Linux as well.

Down with SUIT MUSIC.
This comes from the SUITS in the offices, who've been told by other SUITS with lawyers in them that enough nuisance law-SUITS would force people to buy more of their product.
Dry up the money and the SUITS with lawyers in them will disappear.
Do not buy new music or video, the SUITS get most of the money.
If you must have a cd get it used.
Or better yet, learn to play an instrument- for centuries music existed without SUITS.
