True but the Constitution has essentially been moot since 1933 when emergency powers were given to FDR and have continued to this day. Heck, New York State has a constitutional ban on gambling yet the Governor has been working overtime to get around it by teaming up with Native American tribes and taking a percentage of their income. When you get right down to it now, the Constitution is just a piece of paper that is probably more valuable for its status as an antique than the words that are written on it. |

Not exactly. Gambling is normally done on the reservation, which is in effect either Federal property or a foreign country. Not sure exactly. And that means that NY has no legal authority there. |
