Dear Insightbb.com Customer,

There is important information that you need to know regarding
the role Insight is required to play in enforcing copyrights.

In 1998, Congress passed the Digital Millennium Copyright Act (DMCA)
www.loc.gov/copyright/legislation/dmca.pdf), which allows
copyright holders to enforce their copyrighted material by requesting
that Internet service providers takedown infringing material or
disclose the identity of persons that use the Internet to infringe
on copyrights. Representatives of copyright owners routinely scan
computers through file sharing software or websites to identify
infringers of their copyrights. If Insight is notified by a
copyright holder of an infringement, we may be required to notify a
customer of the alleged violation and turn off the customers service
if the infringement continues. We may also be required pursuant to
the DMCA to disclose the infringing customers identity to the copyright
holder. This is true for any Internet service provider, whether a
broadband or narrowband provider.

Copyright holders are becoming extremely aggressive in pursuing the
rights afforded them under the DMCA. Many of our customers are unaware
that unauthorized downloading of copyrighted music and movies over the
Internet is illegal. File sharing in itself is not illegal, but
downloading copyrighted material from the Internet - without proper
authorization - is illegal. Such activity is also prohibited by Insights
Acceptable Use Policy governing the use of your Insightbb.com High Speed
Broadband service.

We also want to caution you that file sharing can be dangerous to
your computer. Many of the file-sharing programs include other
"sub-programs" built into their software code. When you leave
file sharing ports open to the Internet, it may allow others to
access and use your computer resources to do a myriad of tasks for
their own benefit. Open ports also make you a target for viruses
and put your personal information at risk.

nope i believe that if ask by a court to disclose the name of an ip address holder.they will have to give the name up is how i understood it.

I'm really glad I saw your post. I just received the email and would have flipped out thinking they were after me! I don't share files but I'm pretty sure my son does on occasion. Guess I'll have to think about revoking his "filesharing rights".

When you get an email addressed to Insightbb_Customers, one assumes it has been sent to everyone.

You might want to take a look at this article on the latest versions of KaZaa Lite which are trying to block RIAA and others efforts.

well i thought it was just sent to me because it said customer and not customers.the other day when i recieved an email from the about upgrades taking place it said customers.

If I'm reading it right, it seems to say that Insight will not try to fight the RIAA or MPAA if they should come and ask about a particular Insight user. I guess they just want it to be known that they'd sell you out in a heart beat.

Insight is not trying "Sell out" their customers. The letter basically says if Insight is subpena to supply the proper law enforcement agencies information on InsightBB users who are sharing copyrighted software, etc..etc.. or whatever the case may be, then they must do so.

So, if you're not doing anything like this, then you have nothing to worry about.

Insight provided links to turning off the upload feature in many share apps. The also keep everyone informed about it. Using share apps is supposed to be a violation of the TOS "providing network content to others" but if they provide links for turning off things in it then it seems that it is not so much a violation after all.

Don't worry about it unless your trying to share a bunch of illegal stuff 24/7.

Im like you Indy, I usually grab my stuff from Newsgroups, and on occasion KaZaA Lite. And with KaZaA lite, i'll grab certain files but my status is 'sharing 0 files'

the riaa has said there after the people that are letting users download from them so if you dont share you have less to worry about.i have about 500 files but i dont share.

At this point, I don't think anyone who downloads from a news server has anything to worry about, since they're looking for people who are actively trading files through a specific set of ports. I'm thinking port 119 isn't one of them; so let's just keep newsgroups our little secret, okay?

Besides, if the RIAA, MPAA, et al, start trying to shut down domestic news servers to keep copyrighted content from being posted, that'll just create more business for news servers out of the U.S., like Premium News in Germany.

If the RIAA and other assorted Nazi thugs start bringing the hammer down, I'll shell out $15 a month for Premium news again in a heartbeat.

I work for Insight. We were told about this on 7/23.

I brought this up to my district VP (as I'm an advocate for digital rights, et al), and I was told that Insight will legally fight any subpeona sent to us regarding this information. We will surrender your information to the RIAA only under court order.

We believe in your right to privacy and will fight to maintain it.

I hope this clears everything up.

Some of you may have seen this on the main page if not heres some interesting info on this. The Electronic Frontier Foundation offers filesharing enthusiasts the opportunity to "See If the Recording Industry Is After You". The digital rights activists at EFF began a web page,to search for usernames listed in subpoenas. The EFF also offers timely hints on "How Not To Get Sued By The RIAA". So far it seems the RIAA is going after just the people who share over P2P, but the logical extension of this is they will eventually go after heavy downloaders too. I'm really shocked they haven't tried to force Usenet providers to remove offending binaries* groups. I expect that'll be the next shot in the RIAA's legal war.

I personally will not download anything that is commercially available out of respect to the music industry. There are by the way many many "TRADER FRIENDLY" bands that allow their music to be freely traded and downloaded by the online music community. Check out etree.org for more info. I use the heck out of a file sharing software called FURTHUR check it out here: »furthurnet.org/
