This is something I predicted in Chapter 12 of my 2001 book called "Living

"NETA has yet to be fully tested in court, but it basically puts the forceof criminal law behind the DMCA. Under the NETA your son or daughter could be convicted of a felony punishable by three years in prison for each Brittany Spears .MP3 file in their computers.
Maybe no one will go after your teenager, but if that teenager is a geek and a rabid MP3 fan (many of them are), they may have already acquired enough software and files to be considered a dangerous criminal mastermind."

As far as I understand the NET Act this guy is wrong.
The NET Act covers if you reproduce/share with family or friends copyright material worth $1,000 or more.

From the NET act:
"by the reproduction or distribution, including by electronic means, during any 180-day period, of 1 or more copies or phonorecords of 1 or more copyrighted works, which have a total retail value of more than $1,000, shall be punished as provided under section 2319 of title 18. For purposes of this subsection, evidence of reproduction or distribution of a copyrighted work, by itself, shall not be sufficient to establish willful infringement. "
So it would appear that your interpretation is correct.
