Do not even have to have anything on it (the computer), with a warrant and 'due cause' they can take the computer and have it tied up as evidence for a long time. All it takes is an 'expert witness'. -- I am not lost, I find myself every time. |

Just that the way the laws are written now, the police/FBI/other John Law can with 'due cause' (that is in quotes because many, including many cops apparently do not believe that it is truly due cause) be issued a warrant and told to go get your computer (and you too). Then with the backlog of court cases, your machine is tied up as evidence until after the trial or whatever is finished.
Thus far to the best of my knowledge this has only been done for true criminals and kid porn, but technically it can be forced if the RIAA and associates want to do it. And remember, in the US of A, money talks very loud, unless you can change that to being picked on because you are in certain minority groups.
This is from just one law enforcement source, I do not know how other areas of the country feel about this. And a good lawyer may be able to circumvent some of this. -- I am not lost, I find myself every time. |

Yes they do need a warrant, and the fact that you downloaded files without paying the RIAA et al for them now makes you a hardened criminal. Somehow I do not think that was the original intent of the laws, but that is what the interpretation looks like it is being forced to. -- I am not lost, I find myself every time. |

Unfortunately, I'm like 95% of America. My entire hard drive is filled with copyrighted material.
Since I can't write the code, I'm forced to use copyrighted material. Which I paid for.

Have you not noticed the number of people using P2P software, that have no clue what folder(s) they are supposed to be sharing? Therefore they are sharing their entire hard drive!!!
Are they but COMMON criminals? Or just idiots that have no idea how they are supposed to set up their software?
Not everyone can be a PC expert. Not everyone even comes close to understanding PC security. Even those of us who do understand these things. Hit a snag from time to time.
Will we be locking up all these defined idiots? Or will we give them a mulligan?
When calling for the immediate enforcement of these laws. Be very carefull what you wish for. It could be your 80 year old grandmother that gets hauled off to jail next week.
Don't say this can't happen. Because our NUMBER 1 rule in the US courts is...Ignorance of the law, is not an excuse/defense.
You can't say, quit downloading P2P software. Because WinXP now allows for easy remote access. Therefore can be set up to work like P2P. -- A bird doesn't sing because he has an answer. He sings, because he has a song. |

I should've been more clear---How can they justify a search warrant when the computer has no copyrighted/illegal material on it ? -- The game is tonight, we have to play, we might as well win. |

| reply to RayW True, one would be scared. But I'd insist that they take all the computers in the garage also - several old 8088's, wang pc's, 80286, 80386's and some 80486's. My wide would most likely be very happy to get rid of my old "parts" pc's that could still work, but haven't been turned on in years. One question? Would I have to accept having them returned to me? I have about 50 of 'em but it's a lot of work to take them out to the recyle station. |
