If you are going to make an allegation that the NSA is illegally plying their trade domestically it would have to be heard in the FISA court since they are the only judiciary with the necessary clearances. If the FISA court determines it does involve national security you likely won't hear anything about it.
I also think this has turned into a debate that can't be won by either side just like the debate on the existence of UFOs. Even if this makes it into the courts and the courts find it didn't happen, some will continue to believe the call records were turned over, simply because they are partisan or they don't trust the government.
On the other hand if the law was really broken and there is proof that extends beyond hearsay and innuendo, those responsible should be held to account.
I think the Dems will win in this one by continuing to talk about it. Don't get me wrong, it's definitely a complete violation of constiutional authority.
