as for Primus users getting warnings, it looks like you can at least count myself, danf, sered, and tumble, plus one or two more from the other thread under Canadian Broadband.

So Primus has basically lied to at least 4 of its customers regarding unlimited download.

I love ISPs.

I'v gotten the very same thing and after fighting my way around their phone call center, I had some lady say that I was using to much time, that I was on for more the 3hrs a day, and over 100hrs... a month.

Which is crazy, wrong term and just.. weird.

But they said they will send out a prepaid package to ship their modem back to them.

Their webpage says unlimited and no where do they say anything about being able to end service over bandwidth useage in their TOS.

I'm thinking about having a shipping problem with my modem. As well as taking this issue to the next level.

Ok, I retract my previous statement as this does seem to be legit. So what options have we left? The Primus "No download cap!" is a can of hot steamy B.S.

Should we put something up to have everyone stay as far away from Primus as possible?

If it is a legitimate case of false advertising (save copies of the only documents) then make a claim with the appropriate federal agencies.

Something will have to be done. It's just outright illegal to advertise no cap and enforce one.

ok so just how many of us have they screwed over so far?

as far as i can tell that list is getting bigger and bigger.

do we have a case for breach of contract (the only way we can nail them)?

if so, are people actually willing to band together and file a class action lawsuit?

And I was looking at getting a phone line again ($200+) so I could get Primus DSL so I could have no cap. Well I had better stick with Shaw for now. Been with then since May 24 and Telus since Jan 27 1998 before that (yes MMG days). but what are our options now for a high cap provider? Seems Shaw is the best bang for the buck $47.95 for 50GB without needing a phone line. If you have a phone line then Telus Enhanced $34.95 for 60GB after all discounts and one year contract. Since I gave up my phone, looks like I am stuck with Shaw (who has good support and customer service).

Wow, this is great, we are getting screwed left and right by ISP's in the lower mainland/BC. I guess the next option would be a business license + Bell?

One extra option in the near future might be TekSavvy.
Over on another thread (»Any Western Bell reseller?) they've been talking about an upcoming launch in BC with 100GB cap.

Better a 100GB cap that you know about than a 50GB cap that nobody tells you about until you exceed it!

Well, I have an interesting update. I still haven't had a *direct* answer from Primus yet so I phoned back again, got bounced around a few departments again and finally wound up at Customer Service. As this is the last business day before the disconnection date I'm getting quite pissed off that nobody will give me a direct answer.

First, the tech support guy said I used too much bandwidth. I then demanded an answer to why the AUP doesn't even MENTION bandwidth and why it was quoted in my disconnection letter. I pointed here to the Primus high speed page and pointed out the 3rd point: Unlimited use - No cap on downloads!. I told her that the AUP says 'load on servers' and not 'excessive bandwidth' explaining that these things go hand in hand and you can't advertise one thing without affecting the other and asked for an explanation. Answer: "It's a marketing issue." Then I asked for a manager and got transferred over to a customer service agent (NOT a manager .)

This customer service agent actually gave me an answer (a few answers actually):

-The month in question that caused the disconnection notice to be issued is September, when they report I used 80GB. (This is wrong??? I checked my usage page that I posted earlier in the thread, and it indicates in September I used 133GB, 90GB down and 43 up. WTF is going on here? )
-I am slated to be disconnected on Monday.

I asked then for a manager in this department and I explained what had happened... and she found a note on my account. Apparently because of my complaining, my ticket(s) were escalated to the "executive" level and she informed me this is actually above the manager. It was just escalated this morning and I should receive some communication from someone very soon.

Sooooo now I sit here and wait for my modem to de-sync, it sounds like.

Aargh. [again]

I'm really learning to detest ISPs in general.

Primus is a 50GB cap now. Anyone who got an email is getting terminated on monday. Don't bother calling CS they have no idea what's going on.

I ended up signing up to telus earlier. They have a pretty sweet deal going on at the moment (free ipod, free modem, and 3 free months with a 60GB/mo cap at $39.95/mo) and even though I hear AOL has no cap, I'm not gonna risk it. Hopefully telus wont mind if I go over by a few gigs a month. Really sucks being capped.

You know, I just noticed my download speed fell to 100KB/sec. I wonder if that has anything to do with what has been happening in the last week or so.

I finally got around to registering here, I figured I've been posting enough to register.

they said this month 14th i'm gonna be disconnected because i downloaded 110gb ...i said well its unlimited and she said but you are abusing our system ...then i said ok bye ...well primus suck balls

I just got off the phone with AOL. As much as I dislike AOL, I was on the phone asking all sorts of questions about their service. The reps said there are no restrictions on upload OR download bandwidth, and that the connection will be a 3/0.8 connection in this area. Well, I've tried everyone else... I think when Primus boots me off I'll get them to release the port and try AOL. I just hope that it is actually available here (their computer was being flaky.)

you are not going get call unless you call them first and ask them whats the problem.AFter that they will transfer you to 3 different departments and they will say we dont know whats going on and your account will be under investigation and you are going to be cut off with explanation why .so you can expect call from us in next 48 hours.
if they are saying you are going be cut off on december 5th,then you will be be cut off at that time no matter what you do.I was talking with their supervisor DEAN and he said i was abusing primus servers by downloading 110gb lol.
I kept saying ITS UNLIMITED DOWNLOAD,NO CAPS,and he kept saying YOU DOWNLOADED 110GB AND YOU ABUSED OUR SERVERS !!!

It's not so much the caps that bother me is that they do not have a plan for people that know they use a lot of bandwidth. Hell, I'd be willing to pay extra for a 200GB cap or something. I don't think any of the ISPs would even consider that.
