taken from the Terms of Use;

You must ensure that your activity while using the Services does not improperly restrict, inhibit or degrade any other customer’s use of the Services, nor represent (in the sole judgment of Shaw) an unusually large burden on the network itself, such as, but not limited to, peer to peer file sharing programs, serving streaming video or audio, mail, http, ftp, irc, dhcp servers, and multi-user interactive forums.

Also;

In addition, you must ensure that your activities do not improperly restrict, disrupt, inhibit, degrade or impede Shaw’s ability to deliver the Services and monitor the Services, backbone, network nodes, and/or other network services.

None of that has anything to do with caps.

Bittorrent does all of the above so Shaw is well within their rights to throttle all they want and every single Shaw customer agrees with that when they sign up and sign on the dotted line.

Not really much there to argue about.

no i think you misunderstood the guys point, he was referring to the statement about unlimited access. Meaning it shouldn't be throttled. I think it was an entirely seperate entity from caps.

IE ok they can impose caps, but they should restrict what you can do with the cap. If its unlimited access, then you should be able to have access to everything on the internet your supposed to, including unlimited access to anything that uses p2p.

unlimited access means you can access the internet at any time not unlimited downloading. I think you need to read the terms of use before you start spouting off.

Wow, to the above poster, you sound like a FanBoi for Shaw.

Thing is, we pay for unlimited access, there should be no filtering of packets at all.
Shaw is breaking their own ToC, but of course being the greedy company they are, they have since changed them.

There could be several reasons why you are receiving poor upload/download speeds.

Please contact shaws technical support so they can check the levels on your modem, if they are poor they will be able to send out a technician to troubleshoot / repair / replace and return your connection back to the correct levels.

Heh. I'm not mixing up kilobits and kilobytes, though I'm sure it's a common mistake. Something strange seems to have happened since I ran my last speed test last night, though. My download speed has nearly doubled. It's still not what you'd expect from a cable modem, and since my upload is still weak, it's not gonna help me with torrents, but here it is:

700KB/s would be higher than 5.0Mb, so yes, he's talking about 700kb/s not Kb

kilobit, not kilobyte.

SHAW's high speed inet is rated at 5Mb Downstream and 512Kb upstream so for you to get 700KB/sec download and 50-60KB/sec upload you have a perfectly fine connection. do you realize that with TELUS the max you cn get on a residential DSL line is 2.5Mb??

It's every aspect of my connection. I've run pretty much every internet speed test out there, and my download is never above 700kbps, and my upload never above 50kbps. I've e-mailed Shaw about it, but they're being less than co-operative.

is your upload throttled to 10k? or only your bit torrent uploads?

A couple of weeks ago all Shaw service in my area (Lethbridge) was down for a day or so. Since then, my speeds have been awful. At first I thought it was my machine, but I've done a barrage of tests since then, and between that and reading over this forum, I've concluded that the only logical explanation is throttling.

The real question is, can we do anything to curtail it? If we write enough angry letters and make enough angry phone calls, will it do anything? Probably not. Is there a precedent of an ISP caving to public pressure on this issue? I mean, it's absolutely ridiculous. I don't pay $40 a month so my upload can be limited to 10k/s. Unfortunately, the only other viable ISP in this area (Telus) is also a joke. So really, is there anything we can do about it?
