I would disagree. I don't think I have ever seen a muni that offered cable or dsl without also offering video services.
Wireless munis, yes, but wireless internet is a not a right of ways issue anyway.
A municipal utility is almost never going to meet the requirements for a state wide franchise as laid out in that law.
