Theft is described as "The taking of property with the intent to deprive." What exactly is the AP owner being deprived of? Does his internet bill go up? Does he lose bandwidth? The courts and the FCC have deemed it illegal to intercept ENCRYPTED signals, but at this time it is still legal to intercept open and even scrambled signals. That's how people with scanners can intercept police radio and such and still be complying with the law. I don't think this is right, but at the same time it's not a jailable offense, probably not even fineable. I think a simple "move on" from the police should have sufficed. Immoral, yes, illegal, no. I urge EVERYONE to apply some security to their wireless connections. As far as I know though the laws says its legal as long as the broadcast isn't encrypted. |
