1 edit | [Packet8] Terms of Service (TOS) Updated on 4/15/2005
•New Terms and Conditions of Service (Updated 04/15/2005) •Old Terms and Conditions of Service (Updated 10/29/2004)
Note: In both links above, the PDF file which can be opened up at the beginning of the TOS text points to the same filename (T&Cs_E91110292004.PDF). Thus, the cache'd 10/29/2004 HTML TOS doesn't have a valid link to the 10/29/2004 PDF TOS.
I thought I had saved the 10/29/2004 TOS PDF file, but I can't find it. If somebody's got it, please upload it.
Anyway, the $1.50/mo regulatory recovery fee has now been added to the TOS:
quote: 5.6. REGULATORY RECOVERY FEE. A Regulatory Recovery Fee of $1.50 will be charged monthly to offset costs incurred by Packet8 in complying with inquiries and obligations imposed by federal, state and municipal regulatory bodies/governments and the related legal and billing expenses. This fee is not a tax or charge required or assessed by any government. The Regulatory Recovery Fee will apply to every phone number assigned, including toll free and virtual numbers

Not enough people bothered to complain when lingo did the same, so there is nothing to discourage every other provider from doing the same. Thanks for the link to the old TOS.

| Thanks rcilink for the suggestion; however, I had tried thae Wayback Machine before posting the OP.
They have no captures of P8's web-site in 2005, and their last capture in 2004 (on 10/29/2004) does not contain the TOS from 10/29/2004. It contains the TOS from 7/16/2004.
I may still have the 10/29/2004 PDF file saved somewhere, but so far I haven't found it.

| reply to rizzo2dial Does P8's Price Increase Avoid the Cancel Fee?
I think it does, as long as cancelation occurs before using the phone on May 1. Anyone try this yet? This result is implied in P8's new TOS. In addtion, it follows naturally from P8 changing the TOS unilaterally. The customer can't be held to its promise (one year of service) if P8 doesn't hold to its promises ($19.99 per month). There is no doubt this fee is a price increase. Thoughts? |

Just checked my email, got the official price increase notice so I unplugged the DTA. Will be calling Monday to cancel. My credit card bank advised me to bring in the TOS/contract and the price increase notice so they can prevent P8 from nailing my credit card in the future. Uggghhh! What a pain!
Too bad, I actually liked the Packet8 service. If they had waited until the end of the contract to raise rates, I wouldn't have cared.
Guess I'll try the one-year deal from Sunrocket next. |
