Missing Something?

Maybe I'm missing something but how is Wisconsin going to justify this cost? They don't own the internet or pay to keep it up or anything. Unless I'm missing something, I don't understand how you could tax downloads. It's a private service and not state run or owned...

I don't know if they have sales tax in Wisconsin, but if they do, they don't own the store, pay rent, or pay wages...same concept. They're just looking for MORE money instead of looking at controlling spending on stupid programs a few get the benefit of. Taxes just frustrate me!

So if you get audited what will they look at? Your browser History and cache?

The term "voluntary" as applied to taxes means that you declare what your liability is, as opposed to being sent a bill. It does not mean it's up to you whether or not you want to comply with the tax code.

Technically you're supposed to pay Sales & Use tax on items you bring into the state tax-free. They almost never go after individuals, but they will audit businesses. (at least here in Virginia)

Sales tax is 5% for the state. You can tack on another .5% for the county (at the county's discretion) and then sometimes another .1% for a blackhole project like Miller Park.

We already are suppose to be volunarily paying sales tax on purchases made online.

I hate my state!

Seems it works that way in Wisconsin, too.

said by Article:
Wisconsin taxpayers are supposed to estimate what sales tax they owe on Internet and mail-order purchases, and voluntarily pay it when they file their income taxes. Compliance is "very low," Morgan [state Revenue Secretary] conceded.

Only 24,769 taxpayers - less than 1% of the 2.7 million tax forms filed - admitted that they owed any sales tax on Internet or out-of-state purchases in 2003, figures show. Those taxpayers voluntarily paid an average of $56 in sales tax on those purchases, according to the Legislative Fiscal Bureau.
New York is the same way. There's a line on the tax return where you tally up "use tax" on purchases made out of state brought into NY and add that to the tax liability. New York gives you the option of using a tax table to arrive at an amount if you don't want to add it up. New York uses the same flawed reasoning as Wisconsin does in the article, to "level the playing field" for stores that operate in state. Except I know of no stores where I can walk in and buy a mp3 or WMA file. Or buy an eBook, or a mp4 of a movie. If I can't get it in NY, then there seems to be no playing field to level, does there?

I believe every state has this. If you purchase something from another state and do not pay taxes there you are suppose to pay your state taxes.

I am a reseller of computer and home electronic stuff and some states are starting to get a little silly (CA being one of them). I believe there are now 13 states that require you to register as "Doing Business There" so you have to collect and file sales tax with them. They are enforcing this by "encouraging" the big wholesale vendors (and the small probably)to collect it from people like me in advance or refusing to ship direct. The only way around this is to have it shipped to me and me ship it to the customer.

They call it Consumer Use Tax.

I know of only one person who pays it.

Even if I buy clothes in Pennsylvania (where there is no sales tax on clothing), I am supposed to pay tax on them.

Of course, there is only one paragraph in the tax book that mentions this, and most people just skip over the line on the tax form.
