From the NET act:

For purposes of this subsection, evidence of reproduction or distribution of a copyrighted work, by itself, shall not be sufficient to establish willful infringement. "

So it would appear that your interpretation is correct.

As far as I understand the NET Act this guy is wrong.
The NET Act covers if you reproduce/share with family or friends copyright material worth $1,000 or more.
