Can you provide an example of this? While it wouldn't surprise me, I did a Google search for "artist sued for performing own song" and fould nothing relevent to your claim. I would think I would have heard of something like this. Perhaps not, but it is incredibly hard to break away from labels since they try their hardest to own the copyrights to all produced music under their label.
