Apple vs Samsung patent battle jury reaches decision

The knockdown battle between Apple & Samsung(a stand-in for Google & Android) has come to a decision. The Jury reached a VERY quick verdict after a 3 week trial and the Judge and 2 antagonists are perusing the jury forms before the judge announces the results. The results are expected any minute.

It looks bad for Samsung so far. Jury is ruling for Apple and against Samsung for patent infringement on most of Samsung's smartphones and tablets. Samsung was found to have WILLFULLY infringed. That may mean a big buck award against Samsung.

Yet to come is Samsung's claims against Apple and the summary of how much each party will owe the other.

A jury has found Samsung guilty of infringing at least some Apple patents in the mega-infringement trial between the two companies.

The jury’s verdict, which is now being read, finds Samsung guilty of most of the charges read thus far, which cover various utility patents. The jury also found Samsung guilty of violating various design patents held by Apple.

The jury has yet to announce its decision with regard to whether Samsung willfully violated Apple patents or on Samsung’s countersuit.

Now on to Samsung claims against Apple.

So far Samsung is losing on every claim of infringement against Apple. Bad day for Samsung and Google and other users of Android.
Samsung gets ZERO($0) money in lawsuit.
Samsung lawyers may all need to commit Hara Kiri.

Just shows how stupid the legal system has become.

Now Apple will slap injunctions on importing of most Android products and then demand huge royalty payments like $50 a device.

Apple wins, everybody else, you and me included, loses.

Who needs competition.

The fact that such a complicated trial ends in such a quick, lopsided victory is evidence itself in how well the system can be abused.

oh I don't know. She was equally nasty to both parties. But the Jury obviously loves Apple and the iPhone/iPad/iOS system. Looks like a home court jury in San Jose stuck it to the Korean company.

Now we get to see how much of the jury verdict & award is set aside by the judge as is often the case in big civil lawsuits. And then the inevitable appeals.

Such a quick decision. I'm sure there's a number of Apple Fans on the Jury. This is such a bad, BAD decision. The patents stand too despite obvious need for invalidation.

Also, Samsung is a Korean based company, although they are multi-national and world-wide.

Except maybe the USA.... soon.

But isn't that why Goog bought MOT mobility? Basically counter-licensing? Everyone has a gun so everyone has to behave because a gun battle will end badly for...well everyone.

But it looks like not all their devices were found to be infringing. So Sammy will do some redesigns to some of their handsets and move ahead better than before.

CNET looks at why the Android community should be a little more nervous after today's ruling.

While the monetary damages are significant, they pale in comparison to the precedent set by this jury that Apple's design patents are valid and worth protection, giving it license to go after any company with a similar looking product. That's bad news for any company building an Android smartphone or tablet.

"This is a big loss for Google," said Roger Entner, an analyst at Recon Analytics. "There were actually two parties being sued by Apple. Google just wasn't named."

So yes, the battle may range on for another few years. But thanks to this decision, public perception will be on Apple's side. The decision was so lopsided that it has to make all of the other Android partners a bit nervous. While an appeal is an option, it doesn't look good.

Even as the legal machinations roll on, Android players may indeed start lining up to strike licensing deals with Apple.

Do any of them want to subject themselves the kind of circus that Samsung has had to deal with? Samsung spent the last few weeks revealing all kinds of juicy details and pouring resources into a legal strategy that ultimately was fruitless.

Samsung is by far the strongest Android player, and had the resources to mount the best possible legal campaign. In addition, Google had been quietly providing its own support.

But if all of that wasn't enough, what chances does HTC or LG have if Apple were to begin looking elsewhere? HTC is already smarting from a loss with the ITC, and isn't relishing another legal clash against Apple.

With many Android users already paying a license fee to Microsoft, and now needing to pay an additional fee to Apple, Google's free operating system isn't as free as it used to be.

"Google distributes Android for free, but the IP licensing costs -- from Apple lawsuits and Microsoft's successful IP licensing business -- are getting quite expensive," said Avi Greengart, an analyst at Current Analysis.

In reality Google is in an excellent position. At WORST Google can start charging for licenses and could do it any day they wanted. Android is a proven platform with gazillions of loyal users and handset makers committed.

And where are handset makers going to go? They going to start all over and write their own harrrrrrr-e-ble OSes? No way. They would would eat it with a smile on their faces thankful for the billions they make in profit on the back of Google developers.

And maybe Google could take the dough and really accelerate R&D in the mobile handset space to come up with something really spectacular that will be totally obvious AFTER they do it.

Doubt it. Seriously, the jury questionnaire probably asked about handset use, if you owned a Mac, iPod, Sammy Galaxy or other android handset etc.
