I don't think you are guilty until proven innocent. We have a few lawyers on this site, I'm sure they can elaborate.

Although I am not a lawyer, but I believe that the proper term for civil cases is "preponderance of evidence". In plain English, whatever side makes stronger case for themselves wins.
