no ISP will disconnect a paying customer. They will lose revenue, and precious profits. disconnections will never happen, since a letter from a non-legal body is not proof of a ToS violation(while a Judgement in the rightsholders favor is), so no ISP can kick you off based on this 6 strikes program. Hell, they cannot even throttle you, because if they dont provide 80% of your advertised speed, 90% of the time, you are elegible for service credits and refunds of service, and they wont want to do that, so, at most, its a show to placate the MAFIAA while doing next to nothing. | |

Hate to break it to you, but they can throttle you all they want if they choose to do so. Last I checked, residential level services don't come with much guarantees; now if you have experienced an outage, it would be a good faith thing to do to issue a credit or a refund for the time that you were without service, but I do not think that they are legally obligated to do so. One of the main reasons for credits/refunds is that if they screw over enough people, they might go to mass media and make a stink, as a result that ISP gets bad publicity and loses even more customers as a result.
Now, if you have a business-grade service, that comes with guarantees as well as SLA's specifying QoS, uptime, response time and penalties for not meeting the above. However, you are looking at a significantly higher cost compared to residential.
Now, I do agree that this might just be a ploy by ISP's to placate MAFIAA. Last thing ISP's want to do is lose customers. It's one thing if customers themselves jump ship, but it's totally different if they have to kick them out because MAFIAA says so. Question is, how long will it be before MAFIAA starts bitching and moaning that ISP's are not doing enough?
