You don't have to upgrade when you severely limit what goes through your pipes. There is no incentive when they clamp down like this. It would be a complete waste for them to be upgrading backend under these circumstances.

It is obvious that caps are to:
1. Protect cable tv revenue 2. Keep "upgrades" to a bare minimum
