 | [DSL] attn Rocky .. TekSavvy & Bell PROBLEMS For past 3 yrs I've been watching this merry go around of same problems as then. Bell downgrading profiles when customers leave Bell, to fully deleted profiles Bell downgrading profiles on TekSavvy users Bell THROTTLING .. still and blatantly! Bell DNS drops .. maybe TekSavvy too? Bell blocking content on they're own users as well as Teksavvy users TekSavvy saying it's Bell's fault about low speeds, bad lines, too far away from fiber [CO], etc. etc.
Isn't TekSavvy an actual ISP [internet service provider] ? ... which means TS must provide advertized speeds .. no matter what they need to do to accomplish this. A customer shouldn't run around and get royal-run-around by Bell and/or TekSavvy just to receive basic internet service .. which they overly pay for and so should be "seamless" and problems/issues invisible to users.
Users all across Europe receive [for the equivalent of $42 CDN] .. FULL internet access @ 100 Mbps to Fiber speeds where available [which is in most parts of Europe], FULL spectrum of TV channels, FULL cell phone access [including long distance], FULL access to movies, tunes and most other enjoyment media *Well, accept for UK .. where leadership are as anal-retentive as in North America ... same Knights Templar banking, legal and corporate rip-offs.
And, there are 1000's of users, just in Southern Ontario, out in the cold because of above mentioned PROBLEMS. Why isn't anything substantial being done about it?
Do we, men and women, need to bring this into civil and/or common law courts? How would ISP's react to numerous law suits for being deprived of they're essential services?

| Internet is not an essential service in the legal sense.
Terms of service from the incumbents will inform you in no uncertain terms that no guarantees as to the quality and performance of the service are given. At one time if you read Rogers ToS, you'd realize that all they had to do was put a cable into your house and provide a modem. It didn't have to actually WORK!
Look at the articles on the DSLR news page about Verizon actually INCREASING the price of basic FIOS 15/15 service to over $65 per month, bundled with a contract committment. Canadian carriers look far more closely at the US than elsewhere in the world in terms of "What will people pay us" as we rip them off.
TekSavvy like many ISPs are not an end to end ISP service. Even the once great AOL doesn't provide end to end ISP service. They purchase local loop service for their customers from incumbent last mile providers who have pretty much free rein in controlling the conditions and how they respond to problems etc.
You don't like TekSavvy's service then you can always go to the incumbents like Bell or Rogers etc and pay more and particularly in the case of Bell, still get the same degraded service, low speeds etc.
It's the same elsewhere ... in the US, the 3rd party ISP industry has gone away, because the incumbents convinced lawmakers to bring the legal requirement to offer it to an end.
It's not a good situation, but hey, it could be worse ... there could be a no competition at all, and knowing our incumbent carriers they'd be in a position where they'd milk the existing technology even further and continue to jack up the rates to astronomical sums. |

I might have tin-foil-hat-syndrome, but I think the problems are, at times, deliberately inflicted on Third Party customers.
I moved my father to Teksavvy from Bell about 12 months ago. Since then, almost all the classic issues appeared - jerky video, random disconnects, poor streaming.
He eventually returned to Bell, and all the problems ended.
Maybe the incumbents will, just like with throttling, eventually come clean and say they disadvantaged their competition. By then, what's left? |

BTW ... according to Constitution Act, section 32 clearly states it's for Government employees only. It excludes everyone else by specifically not mentioning them. What proof do you have I'm an employee of Government?  »laws.justice.gc.ca/eng/Const/FullText.html "32. (1) This Charter applies (a) to the Parliament and government of Canada ..." Therefore all non Government men and women fall under common law.
With all due respect, my post is specifically for Rocky to answer comprehensively in a public forum. As his TekSavvy forum is not accessible at the moment, for whatever reasons, this is the next best thing. And, I do not need the usual excuses which have been predominating for last 3 yrs. Thank you.
As far as I/we have investigated Bell infrastructure is paid for and still owned by the people. Bell and others are only the caretaker of such. And so 40% of profits is supposed to go to the people.
In any case, I'm looking for solutions instead of conflict.

This also includes bell's own business customers paying $90/mo+ for 6meg service ive made a few really easy service calls that only involved me calling bell india for people to resolve "slow internet" by having bell put their sync back to what it was the week before.
Bell is too large and disorganized to function smoothly and properly.
Rocky is a busy guy you shouldn't expect to be able to get the CEO to comment on things that are beyond his ability to control. People in bell have made the decisions that have caused you greif.
Teksavvy has been fighting every evil decision bell has made from the first day they do it, However you have to keep in mind at the end of the day bell makes the policies and the CRTC approves them. It would be a much better idea to express your concerns to both your MP and the CRTC and make them aware of how you feel on the issues. |

"bell makes policies .." ... They are only policies and not law. CRTC = government = servant MP = government = servant I, as any individual not working for government, has the right to tell government and servants what to do. Why would I be stupid enough to go see some servant when they serve the government and they're in bed with corporations?
I think some people need to comprehend and realize the gravity and extent of what's being said. |

Sorry, no ... this thread is on a forum on privately held computer located in the United States and available for public view. It is not a matter of public record. DSLReports has every right to do exactly what it wants with it. When you joined DSLReports you were pointed to pages which state this quite clearly. The Consititutions of Canada and the USA have nothing whatsoever to do with that scenario.
In this post, you seem more concerned about the fate of this thread and some right you have to be heard than to do with the actual problems with ISPs in Canada. Where did you get the idea that I thought you were a gov't employee?
Moreover, your reading of the Constitution Act of 1982 is flawed. What you have read is that Charter applies to the Parliament and Government of Canada ... which essentially means that Parliament shall not create laws and the Government shall not enact regulations derived from those laws that violate the charter. It has nothing whatsoever to do with the application of laws either as written or common law.
You posted in a publicly visible forum in which people are free to respond to your comments, and not just the intended recipients. Even if you had written it as an "Open Letter to Rocky of TekSavvy", it would still be open to comments by others. That's the very nature of DSLReports. If you wanted to vent in a closed medium, you might send a letter to an editor at a newspaper, although even that doesn't guarantee no replies, the nature of the LTTE process reduces that! If you wanted a private vent, then you could have sent him an email.
So, that you might get comments is something you might have considered before posting your vent.
I was just stating the reality of the situation. And the poster who suggested the way to solve these problems is to contact the Minister of Industry is right. You seem to believe that you as an individual control government ... well, here's your chance. But I have to say, that the last time I looked, the way we control our government is by the electoral process. Once they are elected, particularly in a majority government, they seem to have the ability to do what they please, even attempting to violate the Constitution and Charter. Thank goodness the Government and Judiciary are at least somewhat independent of each other.
For someone who has supposedly studied law, you sound very confused. Much like the people in the US who believe that when your name on official documents is all capitals, then that is not you, or who believe there's a difference between the US flag with and without a border ... all things that make them immune to the wrath of the taxman. |

SBrook is bang on the money. You've interpreted the Charter in a very skewed way, and not as it applies.
DSLReports is not "public record". Yes. It can be tampered with. You agreed to the terms and conditions when you joined- today. It is a privately held board, with publicly viewable content. That is not "public record".
No, the public does not "own" the telephone infrastructure. It was all turned over to Bell as a private company back in the 70's.
Phone and cable lines are corporately-owned. Your hydro/gas are publicly owned.
Don't kid yourself. Bell customers have the exact same problems as Independent ISP's, and most times- worse. |

ISPs advertise "up to" so as long as you can connect to the internet than you are getting the advertised speed.
