case law is the evolutionary process, yes corparation have too much time and money to spend, finding the cracks and shifting the original intent to their own purposes.

All lawsuits attempt to shift the statutes to a person's/company's own interests. Laws are drafted to enable flexibility.

problem is while Copyright law allows for that backup, technically the DMCA says you cant bypass the DRM.

Which brings up a question, which law takes priority? Copyright law is older and as such should be grandfathered in even with the new laws in place I would think its like the porch on our old house, its illegal under current building codes(too close to the septic tank). However it was built under codes where it was legal and so we could still use it.

Fact is, it hasn't come to the point where it goes to a higher court (supreme?) where a precedent can set.

Nobody is suing people for just downloading.
