they won't fail- the US can just start routing all data from the backbones through a black box and detect and decrypt information; if they don't want you to have it- due to being illegal they can filter it. Easy as pie and they can blame the ISPs using any law they wish to create.
And the pirates will find a way around of it. FTW!
