Megaupload, the popular file-sharing site, was shuttered Thursday and its executives indicted by the Justice Department in what the authorities said was among the largest criminal copyright cases ever brought by the United States. Seven individuals connected to the Hong Kong-based site were indicted on a variety of charges, including criminal copyright infringement and conspiracy to commit money laundering. Four of the members of what the authorities called a racketeering conspiracy were arrested Thursday in Auckland, New Zealand, the authorities said.
One of those arrested was Kim Schmitz, aka Kim Dotcom, Megauploads founder. His attorney, Ira Rothken of California, said neither he nor his 37-year-old client, who resides in Hong Kong and New Zealand, was given the opportunity to surrender. Schmitz was arrested without notice, he said.

According to the indictment, the accused are part of the Mega Conspiracy, a worldwide criminal organization whose members engaged in criminal copyright infringement and money laundering on a massive scale. They are being charged with participating in a racketeering conspiracy, conspiring to commit copyright infringement, conspiring to commit money laundering and two substantive counts of criminal copyright infringement.

Ars Technica has a good article as to why they got busted. These Megaupload guys pretty much shot themselves in the foot by talking about downloading copyrighted material off their servers in internal emails/communication, using internal search engines to look for copyrighted content, not really doing anything about DMCA take down requests other than removing a link (not the actual infringing content), ect.. The feds use that as denial of safe habor afforded by the DMCA. So it looks like these guys really went too far with their shenanigans and it came back and bit them in the ass big time. I guess we will have to see how all of this plays out. |

 1 edit | reply to swintec I find it rather interesting that the list of people arrested included a graphic designer, but Megaupload's CEO, music producer/artist Swizz Beatz, was not indicted along with his associates. His wife, Alicia Keys, was among the artists voicing support for Megaupload.
Enter conspiracy theory...did the RIAA decide to not send the hounds after one of their own, despite his high position in what they claim to be a criminal organization? |
