Interesting that you're having this issue since I have the the same problem with my phone. Thought it might be a software issue, but I might have to take a visit to the Apple Store.
I think the support issue you're seeing is that Apple phone support requires that you have a valid AppleCare plan before they even start talking about anything. If you're out of your free one year warranty, then you don't have a valid plan.

I don't see it as a fault, I never buy extended warranties or insurance on such items. I take my chances. If I bought the extended warranties on all the tech I buy, I wouldn't be able to buy all the tech I buy.
Since you didn't buy the insurance or extended warranties before, then you may be ahead even after this repair. |

I don't buy service plans on ALL my technology either, but in some cases it's well worth it. I always get AppleCare on my MacBook Pros. With the amount of use and travel I get out of it, the initial cost, and the cost for parts, it's a good deal. A lot of times it's a good deal on higher end phones such as the iPhone, which also gets a lot of use and travel, and a non-subsidized replacement is a frickin fortune. I dont buy plans for my television because neither me nor anyone in my family has had a major TV problem for at least 20 years. -- You're so vain... I bet you think this post is about you. |

And after having the wifi go out on my iPhone 3G in just under a year from purchase, I now get AppleCare for all my iOS devices. That, and especially for the iPhone, I must have it/them working. |

I've had 2 IP4's replaced due to the home button sticking. I also picked up an extra year's coverage (Apple Care) just before the 1 year warranty expired. That paid for itself as the phone stopped charging 2 months after the one year mark. If they offer you Applecare on the replacement, I would strongly recommend it for the iPhone. |

With 1 month left on warranty, I took it into the apple store and they replaced it. didn't want to risk it getting worse when it was out of warranty. |
