What action can be taken against mobile home park owner

I"m not sure if this is the right forum or not. If it's not, please feel free to move it mods.
We live in a pretty large mobile home park in Illinois. About 600 mobile homes are in the park. The park is owned by a single individual who owns about 12 other mobile home parks through his coporation. I might add he's the Owner, President, and CEO of the corporation. The sewer bill is added into our lot rents each month and the owner is billed by the township for the whole park. For the last few years, he has been charging each mobile home owner 3.00 over what the actual sewer charge is. The sewer charge was verified by contacting the local sewer dept. Now, it has come to light that the owner has failed to make the sewer payment for the last 4 months and owes the village so far $72,000 in late fees and back bills. Each month it's late adds another $17,000 in late fees. On top of that, the last check he offered the village was wrote on a closed account. The park is going to crap, the roads are horrible, rain drainage is poor after a decent rain, and each March 1st we can count on the lot rent going up $35.00/month. We are already paying 600.00/month and almost all the residents are about fed up with the crap.
What actions could be taken legal or otherwise about this situation.

Ding, ding, ding.... We have a winner! Legal action will take a lawyer so you might as well get one now and start asking the questions.

Reality - you would need to find a buyer and buy him out. If it goes to foreclosure - you all could find yourself out of a lot.

Contacting a lawyer would be something that we would need to get as many residents of the park involved with as possible. Many of the residents here are worried the park will be foreclosed on and then what will happen with all of us. Doing a check on the owner, it seems he's lost 4 parks to foreclosure and 5 more are in the process of being foreclosed on. It appears he's failed to make payments on $200 million of debt. The bank has already foreclosed on his 7 bedroom $6 million dollar mansion and has it up for sale. He had his helicopter repossessed several years ago. The worst part of this whole situation is that he's getting his money from us. So, where is the money going?

Do you have any ownership in this park? I.E. do you own the mobile home and pay him rent for a place to park it or do you just rent? If you rent why not move? In this market there are probably lots of better bargains out there.

It is cheaper to get an apartment or pay for a mortgage on a house.

You should stop paying rent, but keep that money in the bank because you will have to pay it eventually.
A new owner will take over and will want the back rent.

This reminds me of trailer park boys, lol.

A lawyer will just cost you money money and not fix anything. I would contact your local elected officials. They tend to be responsive when voters complain about something. But if the owner is having financial problems, I'm not sure what could be done about fixing the problems.

The mobile home we live in is paid for. It's a fairly nice mobile home and we paid $30,000 for it. That's a pretty good amount of money to just walk away from it. Especially in this economy. I might contact our local State Representative. I know her fairly well as the union I am in is has done a lot of campaign work for her and she speaks with us personally quite a bit. On top of that, it's election time coming up.

In that case I don't think up and moving would be a good idea unless you could turn a good profit on your $30k. I think that the neighborhood should form a neighborhood association of sometime and get a lawyer.

That might be the next logical step. There is lots of retired and elderly people out here on fixed incomes that can't afford to move out. Right now one of the residents is spearheading a picketing campaign out in front of the main entrance to try and draw public attention to the situation. After all, right now the village is using emergency surplus funds to pay the sewer service bill. So actually, all the residents of the village are paying for it. We have gotten front page coverage from the local newspaper twice now. Hopefully, we can get one of the television stations to come down and do a broadcast also.

In the interim, until you get your Park Association up and running, you probably need to gather up all your rental payment receipts to prove you paid your rent for the whole time you've lived there.

my thought is if there is 600 of you, I am kind of shocked you haven't attracted an attorney yet. Hell even one wanting notoriety and pretty much free advertising for their firm or practice wouldn't pass that opportunity up.

If he's not paying his bills which seems to be the case, there is nothing a politician can do. Actually there is nothing an attorney can do either.

What an attorney can do is advise you of your legal rights if the property is reposessed or sold to other owners based on the wording in your lease and/or local/state laws.

The logical answer is - move. $600 / month "lot rent" is absolutely insane. That's more than my mortgage for my house. A house that's attached to the ground with a basement and a yard.

Generally, the legal advice given to a "renter" living on a property that is in foreclosure is this: Keep paying your bill when and where you are supposed to until you receive notice to do otherwise. Never pay cash. Always get a receipt.
Typically the last thing a lender (forecloser) wants to do is drive off paying customers. They've already taken a serious hit. Normally these properties are turned over to an asignee or management company who will contact you regarding any changes in payment. Since this is a corporate holding, this is almost certainly a judicial foreclosure.

Renters normally have no appurtenance right in Illinois. You may want to do some research on the foreclosure judgments for this company. This is normally public record. Also, a call to the state Attorney General's office might be in order.

$600 ?!?!?!?!!! Yikes!! My dad pays a little over $300/month (forget what it is exactly) here in Cleveland and I thought that was steep.

Can you check and see if hes in the process or has the Bank taken the property back, if that's the Case the $600 payment should be made to the Bank and not him.

I would get in contact with the bank its easy to check who's loaned him the money.
