win 7 student version

I know of a student that purchased the Windows 7 upgrade at the special student pricing. He has decided not to use it and wants to sell it. Can I legally buy and install this? I haven't been a student for decades.

This would indicate the student can't sell or transfer it, at least if he got it from here.

But, I'm not a lawyer.

But that sentence did not say anything about a gift of it to Tahoejeff. And of course Jeff could return the favor with a gift to the Student (Say a gift of money).

Tahoe,

Normally when someone asks a question like this you would normally get a whole bunch of people that never fudge on anything tell you "no way, no can do".

This post has received some of the most reasonable replies to something like this I have seen in a very long time.

While M$ may never say it publicly they could care less about the occasional situations like you have described. Now if the guy is buying them by the pallet full and reselling them yes M$ would get upset. But they would not go after the buyers they would go after the illegal sales agent.

If this student is passing on to you a good deal that he no longer wants and has never activated (preferably never opened) - "Go for it".

According to the EULA, he can't sell it to you... but in practicality, it isn't a big deal.

It is a perfect time to take a class to further your education, reduce your guilt and support a local college or community college. I know someone taking a class at a local community college and she qualified for a $300 discount on Photoshop through Journeyed or Academic Superstore... I can't remember which. All you usually need is a student ID or a copy of a bill. She saved way more than the cost of the class.

Keep in mind, if the student has already installed the software and activated it, you might not be able to do so. If the package has been opened in any way, I would not buy it.

microsoft wants some money from you or whoever bought the license, and the promise that will install your copy on only one machine at a time. he could have made a copy of the Key and could use it again or it could be active right now. I would only do it if you know the person real well and trust them.

Unless you really trust them I would not pay for it until you get it activated on your machine so you know nobody else has activated with that key. Also I'd want to be confident that a copy of the key has not been kept by the seller.

just like people selling copys of 7 from the party packs
MS can keep you from selling on ebay but thats about it

It's amazing what crap people put up with that would never hold up in court (including all Microsoft's agreements of adhesion). Did you ever have Dell tell you you wouldn't have a warranty on your system if you removed the original OS! What crap--and what could that possibly have to do with the hardware, the warrantied items? It's like saying that if you buy a Sony record player you can play only Sony records or lose your warranty!

the auto makers tried that very thing once
if you got your oil changed etc. any were else but the dealer it would void your warranty but that got shot down fast

how the PC world can still pull this crap is insane
