FTC's authority gives it the power to shut down companies that appear to be engaged in unfair and deceptive practices, whereas criminal law enforcement agencies have a much higher standard for proving wrongdoing in order to convince a court to shut down an ISP.


Leibowitz said his agency would continue to pursue other ISPs that "provide a haven for Internet criminals."

"This is a signal that we're going to go after you, and you're not going to be able to hide behind the shroud of the Internet and be immune from enforcement action," Leibowitz said.
The FTC may become the main way to shut down these sites instead of the justice dept which has more legal limits on acting.

I don't believe the FTC has actual enforcement capabilities directly. From the press release (the first link in Karl's writeup)

The court issued a temporary restraining order to prohibit Pricewert’s illegal activities and require its upstream Internet providers and data centers to cease providing services to Pricewert. The order also freezes Pricewert’s assets. The court will hold a preliminary injunction hearing on June 15, 2009.
It looks as if the FTC was the one leading the charge, but it still required judicial oversight. For once it looks like the system is working the way it's suppose to.

If the above mentioned is the case, I can probably name many other ISPs that engage in unfair and deceptive practices. Throttling with DPI comes to mind, anyone else want to add to it?
