He did not ask for an "uncaped" (did you mean "uncapped"?) line, and specifically stated he wanted nothing illegal. He was asking about an "untapped" line; presumably a connection not monitored for content by the ISP.

uncapped and untapped are one and the same when it comes to RR. As part of routeen network monitoring all lines are monitored. Speeds are limited based on package purchased, Just like with DSL you r line can sinc higher say 8megs, but ur motem is "caped" at 6megs or lower depending on what the line and modem acan actualy sync at.

Regardless, RR would not kicka user w/o cause. Even using the original posters senario or "war driving" the TOS clears state the end user are responceable for securing their connection and will be responceable for all acts occuring on it. Is it fair? no, but the policy has to be applied equaly to all outherwise u get the " you dident kick bobby, but kicked me, and me and bobby both had for a brife momen unsecured sireless networks".

Actualy your wrong, the act of dowloading a copywrited work, regardless of real or fak, still shows intent to defraud and infringe.
Its legal if he has rights to own the work, such as if he has Stairway to Heaven on vinyl.

you can have a unsecured wireless network and resell it via FON as per TWC deal with FON

The ISP isn't patrolling the Torrent sites. They don't have the time to do that.

The RIAA or MPAA has a bot out there that catches you SHARING the file - not downloading. If you want the file, Stop after you reach 100%!

The RIAA or MPAA or HBO compiles the data and submits it to the ISP. Then the ISP takes action.

I don't know how MaxSync profiles work (as they use in AT&T Southeast); but ATTIS (AT&T Internet Service; formerly SBCIS) does not use MaxSync profiles. They build the profiles at the DSLAM and aggregation router; the modem trains to the profile at the far end, and does not cap the connection speed.

No argument there; but all the folks accusing the OP of "illegal activity" ought to apologize for their allegations. Failure to secure his network makes him as complicit in any illegal activity as failing to secure one's vehicle would make him complicit in the bank robbery facilitated by the theft of his vehicle.

And, yes, I hate car analogies. Where this one falls down is that RR still has a TOS to enforce, and abuse of their network due to their customer's failing to secure his wireless connection is still actionable under the TOS. But that does not make the OP an "illegal actor".

Actually, if it's FON, it's neither unsecured nor wireless anonymous, unless I'm reading the article you linked to incorrectly. And it certainly isn't reselling.

Granted, and there wasent the police knocking on his door. His ISP was notifed by the RIAA, took action based on the IP address they had, which is lined out in the TOS the are permitted to do. And possably as a condition of the RIAA to permit the ISP to allow the user to keep his connection without criminal charges, the user has to go to the web site he sated, admiting involvement, so that if it occures again, it can and will be used as evidence against the customer, and the ISP, can wash their hand of responceablity by saying "hey, we turned him off, he made an agreement not to do it again, we turned him back on, he violated it again, so we cut him off."

While i can have some sympathy to the computer inexperienced this happens to, i feel totaly ok with how this is being handled. Its long overdue, just like the spam drones of compromised pcs should be cut off.
