It seems to me that they'd need to change the asterisk to something like "Actual speeds vary. Advertised speeds reflects first few minutes of download. Off peak times only. Actual speeds after first few minutes of download subject to additional conditions and network management.", and the normal user wouldn't be able to tell the difference.
Oh i'm sure the first cable company to get caught doing that will be charter!
