Telus/Bell txt msg charge can you escape contract?

As the title says,

Do you think this change in service is enough get you out of an existing contract with Bell or Telus?

I have a bell account I would like to get rid of and this increase might be what I was looking for.

Anybody know if this would work?

cell phone contracts in Canada are notorious, and well documented and often used as classroom material in lawschool for their amazing language, making them remarkably air-tight. It's almost impossible to get out of.

Contracts only cover the rate plans, not features.

Im curious about this too. If they start charging for text messages im going to tell them to cancel my account without penalties! Are they allowed charging existing, contracted costumers?

btw, what exactly did change? I haven't received anything regarding rate changes. Is it only on certain plans? I use telus.

15c per incoming text message, if you are not on a text message plan currently - i.e. if you don't pay $x for x messages a month. If you are on any kind of text plan, you won't get charged for incoming.

Over at the TELUS forum, someone pointed out that the TELUS TOS seems to indicate you can dispute the change to the contract (and, I guess, terminate it), but only within 30 days of the change being implemented. So they reserve the right to change it, but you may be able to get out penalty free.

It hasn't been implemented yet, so hold that dialing finger just now.

I called Mobility about this. It seems that they can take you out of a text messaging altogether (i.e. no outgoing or incoming texts). This will cost nothing and you simply will not be able to send or receive texts from your phones.

But either way, you cannot get out of your contract.

I called Bell and opted out of all texting. I'm pay as you go, so no contract to worry about.

Nope. At least not according to this.

P.S. Goldberg is usually very pro-industry. (His posts about throttling will make you cringe.) But on these sorts of one-sided contracts even he is appalled.

More nonsense from Telus. TELUS guarantees spam free text messaging service - no questions asked
